I drove past the Madison Courthouse a few weeks ago and snapped this photo. 27 years ago, I won a jury verdict in this courthouse for a client who suffered serious injuries when a farm implement toppled over from the semi trailer as his boss was unloading it. After the trial, the judge said he had been sitting on information he wasn’t able to divulge until the conclusion of the case. He had seen the life flight helicopter on the day of injury from his home and, although he did not know my client, everything came together and filled in the blanks throughout the trial. Small town, small world.

The time frame a member has to submit medical evidence in support of their appeal in an Ohio Police & Fire Pension Fund disability case is being shortened by 50%. Ohio Adm.Code 742-3-05 will soon reduce the time to submit supporting medical evidence from 60 days to 30 days. We are waiting to learn the effective date of this change; but our first impression is that this amendment is not favorable for members of OP&F.

Every law student learns about the "egg shell skull" plaintiff, a victim of someone's negligence who suffers an unusually high level of damage due to a pre-existing vulnerability or medical condition. The principle is that "you take the person as you find him," meaning the negligent party is responsible for those damages or injuries even though they exceed what a normal person would have had. The same principle applies to workers' comp claims. A case in point is a law enforcement officer sprinting after a suspect, but unknown to the officer, she has bone demineralization and/or osteoporosis. A fracture while running is still a compensable workers' comp claim, even though a normal healthy person would probably have not had the same leg fracture while sprinting.

There are so many different outcomes to work injury claims. Most claims end after a few years either because we settle and close them, or because the claims expire. On our appeal, today the Industrial Commission approved a police officer's claim of a knee injury while walking up stairs wearing all his usual gear (gun belt, police radio, handcuffs, ammo, taser, bulletproof vest, etc.), all weighing about 35 #. The City had argued, and the lower hearing officer had agreed, that stairs were not a hazard of employment, and that the weight of the gear shouldn't matter because it was part of his normal uniform.

A customer who slips and falls in a restaurant has to prove the restaurant was negligent. An employee of the restaurant who has the same slip and fall only has to prove he/she was on the job. The employee could even be at fault for the fall, and it is still a good workers' comp claim.
