Did you know that in Ohio under section 2901.09 there is no duty to retreat in your residence or vehicle?

There's a presumption of Self Defense that a defendant acts in self-defense or defense of another if he/she used force intended/likely to cause death or great bodily harm to another IF the person against whom the defensive force was used unlawfully entered (or was in the process of unlawfully entering) the residence or vehicle occupied by the defendant.

The presumption of self-defense doesn't apply if:

the person against whom the defensive force was used had a right to be in the residence or vehicle; or the defendant used force while unlawfully in the residence or vehicle.

Duty to Retreat?
A person lawfully in his/her residence has no duty to retreat before using force in self-defense, defense of another, or defense of his/her residence. In addition, a person lawfully in his/her vehicle, or lawfully in a vehicle owned by an immediate family member, has no duty to retreat before using force in self-defense or defense of another.

Ohio Supreme Court affirms the 6th District Court of Appeals In State v. Gonzales

Attorney Andrew Mayle successfully argued that the State, in prosecuting co***ne offenses involving mixed substances under R.C. 2925.11(C)(4)[(b)-f], must prove that the weight of the co***ne meets the statutory threshold, excluding the weight of any filler materials used in the mixture.

I have been practicing law for over 12 years and I have noticed a growing trend in criminal law. Prosecutors have increased their use of specifications in drug trafficking cases. Specifications increase the penalty that a defendant is facing and the prison time is mandatory time that cannot be adjusted by a judge.

For example, when a defendant is convicted of trafficking or possession of co***ne their crime is enhanced by ORC. 2925.11(c)(f) when it is determined that the amount exceeds 100 grams. This enhancement requires a judge to sentence defendants to a mandatory minimum of 11 years in prison.

Currently, Ohio courts have not required prosecutors to test the purity of the co***ne to convict a defendant of major-drug-offender status. Prosecutors simply introduce as evidence the total amount of the drug and thus, defendants have been found guilty of the specification without proof of the amount.

Recently, another Ohio appeals court has found that the major-drug-offender specification does not apply in co***ne convictions when the conviction is not supported by sufficient evidence as to the purity and weight of the co***ne (2016-Ohio-7338; 2016 Ohio App. LEXIS 4214).


In, Ohio v. Kiser, an Ohio appeals court found that the specification does not apply when it is not supported by sufficient evidence because the substance was only identified as a white, powdery substance. There was no evidence of its purity, thus the defendant is not subject to enhancement as a major-drug-offender because the amount of co***ne exceeds 100 grams (2016-Ohio-7338; 2016 Ohio App. LEXIS 4214).

Do you need an expungement?

Please note the Expungement laws have changed. The opportunities for expunging criminal convictions have expanded.

Governor John Kasich signed Ohio Senate Bill 337, effective on Sept. 28, 2012, which expands opportunities for individuals to have criminal convictions expunged from their records. Under the new law, individuals with more than one conviction as well as individuals convicted of nonsupport of a dependent – individuals who were previously ineligible for expungement – may now be eligible to have their convictions sealed.

Previously offenders had to qualify as a “first offender” in order to have their criminal conviction expunged. Basically, this meant that anyone with more than one conviction was ineligible for expungement. Senate Bill 337 did away with the first offender requirement.
