We've filed a federal lawsuit on behalf of servers and bartenders at The Goat Restaurant and Bar locations in Ohio, North Carolina, South Carolina, and Texas. The complaint alleges that The Goat paid tipped employees a sub-minimum hourly wage while failing to meet the legal requirements that make a tip credit valid. Specifically, the complaint alleges that management employees received a share of workers' earned tips, that $1 was deducted from each tip payment processed through the Kickfin software, and that employees regularly performed substantial non-tipped work, such as stocking and janitorial duties, while still being paid at the lower tipped rate. Under the Fair Labor Standards Act and Ohio Wage Laws, employers must meet strict legal requirements before they can pay workers less than the full minimum wage. When those requirements aren't satisfied, workers are entitled to recover the difference.
