FLAG is looking for a senior level attorney to join our team! Do you have at least 8 years of experience in family law or another area of law that would complement our current areas of practice (such as immigration, business, probate, tax, or civil litigation)? Do you enjoy working collaboratively with a team? Do you value flexibility and work-life balance? If so, we would love to chat! We currently have two associate attorneys, one paralegal, and two legal assistants available to provide support to another senior level attorney. We are open to a variety of arrangements or situations—maybe you have been thinking about going out on your own but want the support of a firm in place? Important announcement for anyone who has an emergency cell phone in their home (common in situations with domestic violence). The phone will go off on Wednesday for the emergency alert test from FEMA. Remove the phone from the home today!

Thank you to Kate Lievano for sharing a great summary of the concerns around the new iOS update and editability of iMessages. If you are in or anticipating being in a contested divorce or custody situation, turn off your iMessages now and only use text messages!

Apple's most recent iPhone software update (iOS 16) includes a feature that will allow people to edit text messages AFTER they are sent. iOS 16 allows users to edit a message within fifteen minutes of sending it and also allows messages to be deleted within two minutes of sending them.

While this seems like a great addition for people who tend to respond before thinking or send messages to the wrong recipient, this update has serious implications on how text messages will be used as evidence in litigation. This is of particular interest to those of us handling family law cases because nearly every family law trial involves text messages used as exhibits.

Now litigants may have the ability to edit or delete texts containing harassing, threatening, or derogatory language, or other information relevant to a family law case. Theoretically, an individual may even be able to manipulate a text conversation to make an instigator appear to be a victim.

The iOS 16 update will seemingly render messages sent after it's release in September 2022 as less credible. It also means that Courts may have to receive twice the number of texts in order to prove what has and hasn't been altered. (I'm sure judges and magistrates are thrilled at this prospect.)

There will likely be a number of other implications of this update for family law cases. Will Judges view the editing of text messages as bad faith? Or consider it a mar on the credibility of the sender? Will victims still be permitted to use edited text messages to show their protective orders have been violated?

Although it is too early to know the full impact of the iOS 16 update, there will likely be significant changes to how text messages are used in family law cases.

Also, TURN OFF iMESSAGES! Only use texts.
