The deadline for claiming ERC for 2020 is approaching, and there are rumors of an early end in Congress as well as a continued lack of clarity about eligibility requirements. This uncertainty is causing concerns for many businesses.

However, you can consider making a protective claim. This will support your right to the credit even if the rules change, providing you some peace of mind in the process.

If you are unsure about your eligibility or worried about a potential credit reversal, please reach out to our team to discuss how to navigate the process.

Above-median income earners who have tax debt and may be deciding between bankruptcy and IRS programs as relief options, should remember that in the Fourth, Sixth, and Ninth Circuits, they may deduct their actual mortgage payments when calculating their disposable income—even if the actual amount exceeds the National and Local Standards amount. The IRS, though, will limit that deduction to the National and Local Standards amount without substantiation proving the expenses are “necessary living expenses." https://bit.ly/3R1fW4D
