The "simple" act of adding your adult child - or any beneficiary - to your Colorado property's title could end up being incredibly costly for you or your beneficiaries.

I often meet well-meaning, generous individuals who would like to pass their real estate on to their children, sibling, or someone else, without hassle. They don't really know what probate is but heard they should avoid it. They find out about joint ownership with right of survivorship being a quick, easy way to pass property and avoid probate. Sometimes - and most real estate agents are far more savvy than this - I've even had my client's agent recommend this method to pass property to the client's heirs.

However, here are three major issues with this approach:

1) Your beneficiaries will very likely lose a basis adjustment in the property ("step-up in basis") upon your death. This could be 10's or even in the six-figures of added tax liability for your beneficiary. - I promise you this will very likely be more painful than any probate in Colorado.

2) Your property becomes exposed to all of the co-owner's liabilities.. If your child/beneficiary faces a divorce, lawsuit, creditors - then that is now your problem.

3) Your beneficiary now has equal rights on your property. This could lead to disputes about remodels, renting logistics, when to sell, etc.

This is another example of why investing in professional estate planning advice tailored to your situation is valuable. Your family's future is probably something you do not want to go cheap on.

Joint ownership often creates more problems than it solves.

This may look like a lot, but thankfully we’ve got you covered!

A lot of people assume estate planning is:

1) Only for the wealthy and elderly;
2) Is finished once they've filled out a couple beneficiary forms; or
3) Consists of filling out a couple simple forms you can get for free or cheap - and then edit yourself to save money.

But proper estate planning is about much more than paperwork. It’s about creating a coordinated strategy that protects your family, reflects your values, and adapts to life’s changes.

As you can see on the map, most of these issues are things that affect most or all of us - not just the rich. And, if you're an adult, you should have some sort of planning in place as we all know nothing is guaranteed in life at any age.

Online document services have fantastic marketing teams and filling out beneficiary forms is very easy. However, those alone do not strategically provide guardrails if a beneficiary is underage, has or develops special needs, struggles with money or encounters a divorce or lawsuit. They do not connect you with a trusted team of advisors who can speak to your specific circumstances.

A successful plan is about strategy, coordination, and sound advice, based in experience. You will very likely not get that by purchasing a cookie cutter document from a cheap online service.

Having a relationship with a solid team of advisors and communicating with your loved ones regarding your goals will bring everything into alignment. That alignment is what will actually help you reach your goals and keep your family's harmony intact.
