I've sat down with many families navigating dementia and Alzheimer's... and this disease - as most of you probably know firsthand - it's just terrible.

Witnessing someone lose their ability to make decisions, communicate their wishes, or even recognize the people they love most - it's nothing short of devastating. And it doesn't discriminate. I'm so sorry if someone you loved has dealt or is dealing with it.

But I will say this - the families who had a plan in place before the diagnosis - or were fortunate enough to act quickly once diagnosed - were burdened with one less challenging thing to navigate.

The individuals and families who didn't have those documents faced a much harder road during an already challenging time.

Most estate plans I review cover the house, the retirement accounts, and the life insurance.

What many, even most, plans have not planned for are digital assets.

The average person has roughly 200 online accounts... Email addresses, social media accounts, cloud storage containing photos, airline miles, crypto, digital journals, and more.

Often these tech items have no instructions to gain access.

Further company policies are often changing and not up to date to address these issues. Trying to close accounts or gain access can be extremely challenging.

Simply being named Personal Representative, Power of Attorney Agent, or Trustee doesn't usually get you into those accounts.
Facebook doesn't care about your letters testamentary. Apple's theft mode will lock you out of the phone if you try to access it from a different location than where the deceased lived. Two-factor authentication sends codes to a phone nobody can unlock.

These accounts don't die with you. They stay open, accumulate data, and can become targets for nefarious actors.

The fix requires a lot of intentionality, including:
1) an inventory of what you have;
2) written directives for each unique account or other digital assets; and
3) Legal language that specifically authorizes digital powers to your fiduciaries.

Without those three things, you're handing your family a digital mess at the worst possible time.

This is a topic I bring up with every client. We provide a digital "treasure map" but it takes the client's effort to build it out.

We’ve been experiencing a unique trend here at Equinox.

More and more, prospective clients arrive with a detailed plan already in hand, detailing exactly how their documents should be drafted alongside very technical specifics.

Our guess is that AI tools and online document services are driving this.

People punch in their details, get back confident-sounding output, and arrive ready to instruct rather than consult. I research things before hiring professionals too, however, there are real limitations here.

Those platforms are built for a cookie-cutter situation. They don't know your family, your assets, or the tradeoffs that only become visible once you dig in. The output is only as good as what went in, and what goes in is usually incomplete.

I've drafted hundreds of unique estate plans and trusts, and that context shapes how I think about your plan in ways a chatbot summary can't replicate.

You wouldn't hire a plumber, an electrician, or a dentist and then send them a tutorial with recommended steps for replacing a pipe, installing a new electrical system, or inserting a filling, right?

Naming a guardian for your minor kids is often among the hardest decisions to make in an estate plan.

I've seen parents put off the whole process just because they couldn't face that one question.

I get it - it's a scenario we hope our loved ones and children will ever have to encounter. But not making a decision on who you'd like to name is still a choice. And not acting doesn't eliminate that small risk that something does happen to you.

If you don't nominate anyone, a judge will be left to appoint someone... and just about anyone can petition the court to be guardian - that crazy uncle, a sibling you don't trust, someone who does not align with your values or approach to life. Of course, foster care could be an option if no family or other potential legal guardian is available or willing to take them.

Further, judges are busy, and if multiple people petition, that judge won't have much time to make an informed decision on who should be named.

Don't leave it to court, chance, or increase the chance of conflicts. Act now!
