Who Can Contest A Will?

Before deciding to contest a will, you should first determine if you have a legitimate claim and legal standing to contest the will.

You may contest a will if:
• You were included as a beneficiary in the previous will.
• You are also a beneficiary in the current will.
• You are included as a beneficiary in a new will that was made after the one in question.
• You would qualify to inherit if there was no will. This includes family members, spouses, children and to some extent, parents, siblings to the deceased and other relatives.

What Happens If A Will Does Not Mention A Child?

Most wills begin by identifying all of the decedent’s living children. However, it may happen that a couple makes out a will early in their marriage when they have fewer children. In their late 30s, they have a surprise child and forget to update their will to include him.

If their will is clear that the couple’s assets are meant to go to their children and one child is not mentioned, that child has the right to file a claim, arguing that it was the intention of his parents to include him. If the last date of the will being updated matches this argument, the courts will usually honor such a claim.

How Is A Personal Representative Appointed In Colorado Probate Court?

This depends on whether or not there is a will. If your loved one has a will, a personal representative is named in the will, along with an alternative representative if the first person cannot fulfill that role.

If there is no will and your loved one’s estate is intestate, the court will appoint a personal representative of the estate based on Colorado intestate statutes. The statutes provide that a surviving spouse is given first priority for this role, followed by adult children. All adult children would have an equal standing and would then be followed by surviving siblings, parents, and grandparents of the deceased. Extended relatives are given the last priority.
