To be considered a Rising Star, honorees must be under 40 years old or in practice for no more than 10 years. They are selected by Super Lawyers, a division of Thompson Reuters, based on independent research, peer nominations, and evaluation by an advisory board. Judicial Leaks--NOT in Texas!

Recently, the Texas Supreme Court's Chief Justice was asked if Texas law prohibited such leaks from happening at the (Texas) Supreme Court--and if so, if the Chief perceived a need to enhance penalties for violating the prohibition. Chief Justice Hecht referred to Chapter 39.06 of the Penal Code, which reads:

Sec. 39.06. MISUSE OF OFFICIAL INFORMATION. (a) A public servant commits an offense if, in reliance on information to which the public servant has access by virtue of the person's office or employment and that has not been made public, the person:

(1) acquires or aids another to acquire a pecuniary interest in any property, transaction, or enterprise that may be affected by the information;

(2) speculates or aids another to speculate on the basis of the information; or

(3) as a public servant, including as a school administrator, coerces another into suppressing or failing to report that information to a law enforcement agency.

(b) A public servant commits an offense if with intent to obtain a benefit or with intent to harm or defraud another, he discloses or uses information for a nongovernmental purpose that:

(1) he has access to by means of his office or employment; and

(2) has not been made public.

(c) A person commits an offense if, with intent to obtain a benefit or with intent to harm or defraud another, he solicits or receives from a public servant information that:

(1) the public servant has access to by means of his office or employment; and

(2) has not been made public.

(d) In this section, "information that has not been made public" means any information to which the public does not generally have access, and that is prohibited from disclosure under Chapter 552, Government Code.

(e) Except as provided by Subsection (f), an offense under this section is a felony of the third degree.

(f) An offense under Subsection (a)(3) is a Class C misdemeanor.

However, there seemed to be a consensus that Texas should enhance the penalty for this type of breach and we will probably see legislation on this subject matter in 2023.

The State of Zoom Hearings & Supreme Court Report

The Texas House Committee on Judiciary and Civil Jurisprudence met last week to take up one of its interim charges: to oversee the implementation of relevant legislation passed by the 87th Legislature and conduct active oversight of all associated rulemaking and other governmental actions taken to ensure the intended legislative outcome of that legislation. Although most family law issues are heard in the Texas House on Juvenile Justice and Family Issues, this committee is still important to the overall practice of law and court issues.

Chief Justice Nathan Hecht testified before the Committee about the state of remote hearings. He indicated the consensus is that jury trials just don’t work that well remotely. However, every type of case or locality may have more or less success using remote techniques. According to Justice Hecht: “Participation in family law cases, for example, have increased by 80 percent due to the wide availability of remote proceedings.”

The possibility of further use may require the Office of Court Administration to enter into outside contracts or make additional hires in order to keep up with the changing technology. He also mentioned the Supreme Court Advisory Commission (SCAC) is in the process of writing rules and will hopefully be finished by the end of the year.

It appears that the Texas House Committee on Juvenile Justice and Family Issues shall initiate a Study on how child support is calculated and administered in Texas along with how the Texas method compares to other states' plans for calculating child support. The Study shall work to identify modern trends across the country for calculating child support with an emphasis on alternative methods for calculating child support, each parents' share of responsibility for the child support, health care, childcare, and other matters.

There is no current report on when a committee hearing will occur. This is obviously an issue that could have a major impact. Stay tuned.

Texas law makes it difficult for children who were adopted to access their original birth certificates, creating complications later in life for those who might want or need that information. Texas, like 17 other states, issues a new birth certificate to an adoptive child and seals the original, forcing adoptees to go through a lengthy court process to access it. Recent attempts to amend state law to make accessing the information have gone nowhere, with a bill in the latest legislature dying in committee.

Texas born adoptees can’t access their original birth certificates until they’re 18. Even then, they have to already know the names of both of their birth parents. Otherwise, the adoptee will have to petition the court.

Survivors of family violence in Texas are seeing their risk of homelessness climb as overburdened shelters turn away more potential clients. The increase in callers seeking transitional housing has grown along with incidents of family violence during the COVID-19 pandemic, but the number of available beds has not kept pace. The Texas Council on Family Violence reported that almost half of the state's emergency shelters turn away six or more applicants each month.

According to a report from the Texas Council on Family Violence, six or more survivors are turned away from shelters at 47% of transitional housing programs.

Bexar County commissioners are considering requests for more funding to address family violence on both the criminal and civil justice systems. On the criminal side, county officials have expressed support for additional funding to be used to bring in visiting judges and improve monitoring services that could warn domestic violence victims when their estranged partners come in proximity. Two civil court judges have also asked county officials for $3 million to fully fund a third Children's Court, but that proposal appears to have less support.

Oregon courts are determining if it is prudent to expand the practice of law to paralegals in certain limited areas. Other states have created programs for such things, where paralegals have the ability to represent clients in limited court proceedings such as divorce/custody, and landlord/tenant actions. This movement could potentially save individuals money as they would be charged a lower rate than an attorney would require for the same service.

When a former spouse fails to fulfill a court order to refinance a property once jointly held in their own name, their former partner remains responsible for a mortgage even if their name is no longer on the deed. That means that their credit can be damaged if the spouse in possession of the property fails to make timely mortgage payments. Beyond returning to court to have a judge enforce the order, there are a few options left to the aggrieved party, including filing a lawsuit against the ex. Another option would be to declare bankruptcy, which would remove the obligation to pay the loan but would also remove any interest in the mortgaged property.

A robbery suspect in Groves, Texas, who told police he tried to stick up a convenience store to get money he needed for an upcoming child support payment, has been indicted. Police say that despite his attempts to disguise his appearance, a store clerk recognized Mauro Danilo Suazo Jr., who faces aggravated robbery charges, as a regular customer who lived nearby.
