Socrates - father of Western philosophy - is believed to have said "I know that I know nothing." Yet, in our lifelong quest to learn we should not take knowledge already acquired for granted.

Case in point - I was surprised to learn from a founder that he did not know he could apply for a trademark before he was using the mark in commerce.

You can apply for a Section 1B registration before you are using your mark and still get nationwide priority over competitors.

9% inflation has not hit the USPTO fee schedule - do not delay filing your application for trademark registration even if you aren't using your mark yet.

FYI - you can start protecting your brand even if you are not selling yet.

I met a founder recently who wanted to know when to file a trademark registration for his brand. He was surprised to learn that you can apply for federal trademark registration and protect your brand BEFORE it goes live.

Here's the 10,000 feet overview: i) File application for trademark registration based on your good faith intention to use it (Section 1B) ii) Once your application is examined and approved file a specimen showing your mark in action. There's a nominal fee to file the specimen and you can extend the time for filing.

If your brand goes a different direction simply cut your losses and abandon the application.

My advice to this founder and others like him is this: do not wait to protect your brand - your trademark application can be tailored to your situation unless a competitor beats you to the trademark office!

For-profit business in an opportunity zone in Allegany County, Garrett County, Somerset County, Wicomico County OR in an Opportunity Zone that overlaps with a priority funding area in ANY jurisdiction should apply.

Paramount Pictures is in a bit of a dogfight following the release of “Top Gun: Maverick.”

Paramount Pictures was sued for copyright infringement by the family of the author whose story inspired “Top Gun.” The suit alleges that the major film studio filmed and distributed the sequel without permission to use the copyright.

Here are our takeaways:
