An absolute divorce revokes previous spouses from beneficiary designations in a will as though they were never there. This does not carry the same automatic rule with power of attorney documents. It's best to update all documents where your ex-spouse is involved. It is always best practice to revoke and redraft so there is no confusion, misunderstandings, or unintended authority.

A common inadvertent estate planning mechanism older adults revert to is adding adult relatives to their bank accounts. While this may seem convenient, it may have harsh consequences.
The co-owner has full access to the account and can withdraw without consent.
The co-owner's creditors have a claim to the account in any legal actions.
A co-owner may contradict your estate plan if you designate someone else to inherit it upon your death.
What are some ways to avoid these pitfalls? Assign a power of attorney that ends at death. A durable financial power of attorney grants access not ownership. A power of attorney is a fiduciary which means, they can be held accountable for mismanagement. A power of attorney does not create inconsistency for your estate plan because they are acting for you not with you as an owner.

Joint ownership could be viewed as inadvertent estate planning. Somewhere down the line, one of the owners’ estates will be probated if all owners refuse to make a plan.

Joint ownership is good for the first death, but not for the last. Find ways to either avoid the probate process or handle it with clear instruction.
