Just an FYI - Starting today make sure not to get arrested on any charge which requires a bond to be set by a Judge or for which you'll need a hearing for an OR, bond reduction or to quash a warrant prior to being released. Idaho Court Administrative Rule 44(11) provides that all federal holidays are non-judicial days in Idaho.

President Trump's recent declaration that December 24 and December 26 are federal holidays this year means that Idaho state courts are closed starting tomorrow morning (December 24) and will not reopen until Monday morning December 29.

If you have a hearing scheduled for December 24 or December 26 make sure to contact your attorney today to get information on what to do. If you don't have an attorney contact the clerk of the court for the county in which the hearing is to be held.

It's really difficult to find holiday time for a law office so I've always assured my office staff that our office will close on all non-judicial days. I'm honoring that promise and so my office will be closed on December 24, December 25 and December 26, 2025.

If you need emergency legal assistance from my office please call and leave a detailed voice message including your name and return phone number or send me an email. I will receive transcribed voice mails and emails when the office is closed and will get back to you as soon as I can.

Good morning! I've called off my staff today because the road conditions aren't really conducive to non-emergency travel yet. We have the blessing to meet a number of awesome people every year, but we'd prefer not to meet awesome people on July 5th after they've run afoul of local law enforcement over the weekend.

Please remember that the 0.08 blood alcohol concentration limit is a low bar and a single strong cocktail provided by a generous bartender or gracious friend can put some people over that limit. A couple strong cocktails provided by generous bartenders or gracious friends probably will put most people over that limit.

Although there are legal and factual defenses to charges of Driving Under the Influence and Boating Under the Influence, the best defense is always not to get charged with the offense in the first place.

We're already seeing fatalities on the local waterways this year and locals and returning tourists alike understand that anyone driving after dark received special scrutiny, especially around closing time.

Local law enforcement agencies are conducting land and water DUI/BUI emphasis patrols starting today. The penalties for DUI in Idaho are much more difficult to navigate than they are in many other states.

Yesterday Idaho Governor Brad Little provided some clear and concise guidance on COVID-19, the illness caused by the new coronavirus (SARS-Cov-2) which has been increasingly causing health concerns in many places including the Inland Northwest.

Governor Little's declaration of a state health emergency in Idaho related to COVID-19 has prompted the Idaho Supreme Court to issue an emergency order regarding judicial operations from March 16, 2020 to April 10, 2020. You may hear rumors that all pending criminal cases have been either dismissed or have been continued to a later date and/or that all civil hearings and trials scheduled to occur during that period of time have been vacated or continued ('continued' is a legal term meaning 'delayed to a later date'). Those rumors are NOT true.

What has happened is that the Idaho Supreme Court has provided guidance to trial court administrators, administrative district judges and trial judges which suggests that trial judges should delay many hearings which do not involve emergency situations and should consider conducting hearings which must occur either telephonically or by video conference where that technology is available.

The Idaho Supreme Court has also suggested that members of the general public not attend court proceedings in which they are not a party or a witness and that persons who are not parties or witnesses or who are ill or are in high risk groups for COVID-19 be excused or excluded from court proceedings and court facilities.

There are many aspects to the Idaho Supreme Court's Order and if you have matters pending in Idaho state courts you should read it. Images of the 4 separate pages of that 4 page order converted to .png files are attached to this post.

The bottom line is that hearings and proceedings scheduled in the March 16, 2020 to April 10, 2020 time frame very well MAY be delayed or held telephonically but that isn't automatic. You can't know whether your hearing or trial has been affected by the Idaho Supreme Court's order unless you have received specific instructions from the clerk of the court or your assigned judge regarding your hearing. You should call your attorney's office for specific instructions regarding your case. If you are unrepresented you should contact the clerk of the court for the county in Idaho in which the proceeding is to be held. United States District Court and United States Bankruptcy Court proceedings are not affected by the Idaho Supreme Court's Order and those courts have issued their own directives regarding their operations.

We ask for your courtesy and consideration in that regard. After almost 16 years on Sherman Avenue it's time to transition five blocks west to Northwest Boulevard. Locals will know it's the same street, just a different name. Construction concluded today and we have keys 😃 The office will close tomorrow through Monday the 20th and reopen Tuesday, March 21 in our new location. Our office phones will forward to me and our office fax to my residence while our phone numbers are transferred to the new office on Friday, March 17th. Sneak peak at our new office space (The photos are a week old and construction is slated to be completed next week).

As many of you know we decided to add civil case, family law and child custody mediation to the services which RICHARD K. KUCK, PLLC is able to offer to customers and professionals in Idaho and Washington. I became certified as a child custody mediator and civil case mediator in Idaho in 2015 and the sale of our existing office space in the Di**le Building in downtown Coeur d'Alene has prompted us to relocate to much larger office space in the Coeur d'Alene North office suites, also downtown Coeur d'Alene, and to remodel the new space into a law and mediation office featuring three in office conference rooms and additional reserved access to the shared conference facilities at the Coeur d'Alene North.

Our law office will be closed from Friday, March 17, 2017 to Tuesday, March 21, 2017 as we move the office to our new location. Our telephones and fax line will forward to us at all times during that move, so you will be able to contact us without interruption during our move.

The new office has some amenities which we have been unable to offer at our present location, including complimentary indoor parking in the Coeur d'Alene North parking garage (accessed off of Lakeside Avenue) for visiting professionals, customers and clients during appointments and mediation sessions.

So we're excited share that effective Tuesday, March 21, 2017 the physical address for RICHARD K. KUCK, PLLC will be 250 Northwest Boulevard, Suite 104, Coeur d'Alene, Idaho 83814.
