An Iowa bill (SF 2172) now being debated at the Capitol would let couples, at the time of marriage, opt out of no-fault divorce. That means they only get divorced by proving fault (like adultery, abuse, felony conviction, abandonment, or long separation), & if neither spouse can prove fault, they would be denied divorce by the court. Critics say this could trap people in unhappy or unhealthy marriages & pressure vulnerable spouses to stay due to the cost & difficulty of proving fault.
Ben Lynch Law maintains a robust divorce law practice & anticipates issues w/ this bill if it becomes law.
