ALERT:
USCIS will extend, through Oct. 4, 2021, Temporary Protected Status (TPS) and the validity of certain TPS-related documentation (Form I-766, Employment Authorization Documents (EADs); Forms I-797, Notice of Action; and Forms I-94, Arrival/Departure Record) for beneficiaries under the TPS designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan, provided that the affected beneficiaries remain individually eligible for TPS.

Beneficiaries under these TPS designations may also apply for new EADs, if they wish, according to the procedures set forth in the Dec. 9, 2020, Federal Register notice (FRN).

Update: Deferred Action for Childhood Arrivals

On November 14, 2020, Judge Nicholas George Garaufis of the U.S. District Court for the Eastern District of New York issued an opinion regarding the July 28, 2020 memorandum signed by Acting Secretary Chad F. Wolf. On December 4, 2020, Judge Garaufis required the Department of Homeland Security (DHS) to take certain actions to implement his November 14 opinion. As a result, effective December 7, 2020, U.S. Citizenship and Immigration Services (USCIS) is:

*Accepting first-time requests for consideration of deferred action under Deferred Action for Childhood Arrivals (DACA) based on the terms of the DACA policy in effect prior to September 5, 2017, and in accordance with the Court’s December 4, 2020, order...

You may request DACA if you:

-Were under the age of 31 as of June 15, 2012;
-Came to the United States before reaching your 16th birthday;
-Have continuously resided in the United States since June 15, 2007, up to the present time;
-Were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS;
-Had no lawful status on June 15, 2012;
-Are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and
-Have not been convicted of a felony, significant misdemeanor,or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.

* BREAKING NEWS *

A federal judge has reversed the Trump administration's latest round of rules placing further limits on the Obama-era program that shields undocumented immigrants who came to the country as children from deportation.

Under the order filed Friday, Judge Nicholas Garaufis of U.S. District Court in Brooklyn instructed the Department of Homeland Security to begin accepting new applications for the Deferred Action for Childhood Arrivals program as soon as Monday.
