There’s been a lot of talk about the commission law suit in the news recently. Think it’s important to note that commissions have always been negotiable, both on the seller AND buyer side of the transaction, although it was common for them to fall into a typical range. This shouldn’t be a surprise…agents know the job at hand, and they know what their efforts are worth. What will change because of the law suit is that the “offer of cooperation” which had traditionally been established by the listing brokerages, at the sellers direction, will no longer exist. Buyers and their agents will now decide what the appropriate fee is, and how it will be paid. I suspect that in many cases, buyers will still ask that the fee be paid by the seller…mostly because many buyers struggle to come up with required down payments and closing cost, and taking on the payment of their agent will be burdensome. When all is said and done, I don’t think any of this significantly change the net dollars a homeowner will receive selling their property. Who pays what may get shuffled a bit, but this will be reflected in the offers. So who’s the big winner in all this? The lawyers who filed the suit of course! One article I saw said the lead law firm expected to collect over $80,000,000 in this case.

Put two new listings on the market end of last week. Dozens of showings. Email went out to each of the agents who showed the properties asking for feedback. About 1 in 5 replied.

Think it’s a common courtesy for an agent to give some feedback after showing a home. Not for me the agent….for the PROPERTY OWNER. We can do better people.
