WHEN A COURT ENTERS AN ACQUITTAL, THE CASE SHOULD BE OVER.

In State v. King, the Ohio Supreme Court allowed the State to appeal a post-verdict judgment of acquittal.

That is deeply troubling.

A Rule 29 acquittal means the prosecution failed to present legally sufficient evidence. The State already had its opportunity to prove guilt. Allowing an appeal after acquittal weakens double-jeopardy protections and destroys the finality an acquittal is supposed to provide.

The government should not get repeated chances to preserve a conviction after failing to meet its burden.

One prosecution. One opportunity. When the evidence is insufficient, the case should end.

TODAY, the Supreme Court ruled that a prosecutor can appeal a judge's decision to overturn a jury's guilty verdict.

🚨 NEW OHIO TRAFFIC STOP LAW SIGNED 🚨

Governor DeWine has signed Ohio House Bill 492 into law, and every Ohio driver needs to understand what this means.

According to Cleveland 19 News, the new law will require both drivers and passengers in a vehicle stopped for a moving violation to provide their:

✅ Name
✅ Address
✅ Date of Birth

This law is set to take effect on October 5, 2026.

Here is the key point: this does NOT mean you should start answering every question during a traffic stop. You still have rights. You still have the right to remain silent beyond the legally required identifying information. You still have the right to be respectful, calm, and avoid making statements that can later be used against you.

Do not argue on the side of the road. Do not escalate. Provide what the law requires, clearly state that you do not wish to answer further questions, and contact an attorney if you are cited, searched, detained, or charged.

The Elkhatib Law Office will continue monitoring how this law is enforced across Ohio.

Know your rights. Protect your record. Call us if you need help.

A.I. IS NOT PRIVATE!

Many people assume that chats with AI tools like ChatGPT, Claude, or Gemini are confidential. They generally are not.

Courts have increasingly allowed law enforcement to obtain AI chat logs through search warrants and discovery requests during criminal investigations. Unlike conversations with your attorney, communications with an AI chatbot are generally not protected by attorney-client privilege.

Why?

• No legal privilege: Chatting with AI about legal issues or even asking it to help draft legal arguments does not create an attorney-client relationship.

• Third-party access: AI platforms’ Terms of Service typically disclose that user inputs may be stored, reviewed, or disclosed in response to lawful legal requests. That significantly weakens any expectation of privacy.

• Deleting a chat isn’t necessarily deleting the data: Removing a conversation from your screen does not necessarily erase it from the company’s servers. In some cases, providers may be required to preserve and produce those records.

The takeaway: Never assume anything you type into an AI chatbot is private or confidential. If you’re facing a criminal investigation or need legal advice, speak directly with a LAWYER —not an AI chatbot.

**CASE DISMISSED**

The Elkhatib Law Office was proud to stand beside Elijah Fowlks and his family in Erie County after Elijah was accused of a crime he did not commit.

At just 17 years old, Elijah was indicted and forced to sit in the Erie County Jail for months, away from his mother, his family, school, work, and the life he should have been building. The case was not based on independent evidence showing Elijah committed a crime. It was built on association, assumption, and a rush to judgment.

That is exactly why strong legal representation matters.

Elijah and his family trusted The Elkhatib Law Office to fight for him. Associate Attorney Emily Korona zealously represented Elijah, challenged the State’s case, and refused to let an innocent young man be pushed through the system without accountability.

After months of fighting, the case was dismissed with prejudice.

Elijah and his mother never gave up hope, and we are grateful they trusted our firm to help deliver the outcome he deserved.

The truth always wins.

Ohio’s ma*****na laws CHANGED this week.

Here’s what that means for you:

1. That w**d you bought in Michigan — ILLEGAL to have in Ohio now.

2. The Delta-8 at your local smoke shop — ILLEGAL.

3. Smoking on a sidewalk or bar patio —ILLEGAL.

You CAN still buy, possess, and grow.

But the line between legal and criminal just got a lot thinner.

Don’t find out the hard way. If you have questions or you’re already facing a charge, call us.

If your 4th Amendment rights are at risk during a POLICE arrest or investigation, PROTECT your digital privacy before police ever touch your phone.

On iPhone, go to Settings → Privacy & Security → Lockdown Mode → Turn On & Restart.

A secured phone helps keep your private messages, photos, location history, financial data, and attorney communications protected unless law enforcement gets proper legal authority to search it. Privacy is not obstruction. ITS A RIGHT!

“Gracious in permitting?” 😂

This is so absurd it’s funny. Max Miller didn’t “permit” anything—he had no choice. The Tesla data we provided flat-out shows the windows were closed, and there’s no world where he could’ve heard these supposed “threats” on a freeway at 70+ mph. Come on Cuyahoga County Prosecutor's Office

Today, Dr. Feras Hamdan—WITH REPRESENTATION BY THE ELKHATIB LAW OFFICE, IN CONJUNCTION WITH THE PATTAKOS LAW FIRM—accepted a resolution in court that the Judge called “REMARKABLE.”

Let’s not dance around it: THIS IS A MASSIVE WIN.

This case started with FELONY-LEVEL EXPOSURE and accusations that can ruin a person’s name—especially the claim of ETHNIC INTIMIDATION. Today, it ended in MINOR MISDEMEANORS, including a traffic offense for WILLFUL/WANTON OPERATION (RECKLESS OPERATION). THAT DROP-OFF SPEAKS FOR ITSELF.

And it didn’t happen because anyone got “lucky.” It happened because THE FACTS CAME IN—AND THE STORY DIDN’T HOLD UP.

OBJECTIVE TESLA VEHICLE DATA, major contradictions in the accusations, shifting public statements (including edits), and the inability to make a reliable identification at the time of the incident exposed exactly what needed to be exposed: THE CORE ETHNIC INTIMIDATION NARRATIVE WAS NOT SUPPORTED BY THE EVIDENCE.

Dr. Hamdan is a physician. He’s a Clevelander. He deserved the truth to be measured by PROOF—NOT HEADLINES, POLITICS, OR NOISE. Today’s result reflects that.

Thank you to everyone who stood with Dr. Hamdan and his family. WE’RE MOVING FORWARD, AND WE’RE NOT DONE RESTORING HIS NAME.
