We have a primary election coming up May 3rd, 2022, here in Bradley County. There are some very important races being run, including Judge races. Many people have little or no experience with the justice system and so when these elections are held, it becomes nothing more than a "popularity contest". So, I urge you to become educated on the candidates and their qualifications before casting your vote. Ask a lawyer, court personnel or law enforcement personnel about the candidates' qualifications and experience in the legal system. These are the people who are around these candidates day in and day out, and so they are very familiar with them. Our right to vote is an important part of how we govern ourselves. Exercise that right.

Kudos to our Judges of the 10th Judicial District which includes Bradley, McMinn, Polk and Monroe Counties. They were to submit a plan for court proceedings and rules to the Supreme Court of Tennessee regarding COVID-19. Although they were not the first district in the state to be approved, their plan was approved today without revisions or amendments. I will post the plan for all to see the work and effort put into this. Access to justice is alive and well.

The Supreme Court of Tennessee recently issued a new order which essentially has each Judicial district across the state develop and submit a plan for approval as to the means by which the Courts will conduct business during the month of May. Our courts are slowly but surely returning to some semblance of normalcy. Hearings and mediations are being held with health precautions still in place both in person and by applications such as Zoom. Please consult an attorney to help you with your legal needs, especially in these times. My office remains open with precautions being practiced. As my voice mail message says as well as the note on my door, my office is open to serve your legal needs just not for walk in business. This allows me to have my capable paralegal present full time. In response to the Corona Virus pandemic the Tennessee Supreme Court issued an order today prohibiting and in effect cancelling all in person hearings and trials until April 1, 2020. There are exceptions to this which most importantly include orders of protection, Dept. of Children’s Services hearings and other emergency related hearings. So there is still access to the Courts in limited circumstances. Also some hearings could potentially be held by phone or video conference. You may view and read this order on the Tennessee administrative office of the courts website. My office will remain open and will work with you to accommodate your continuing legal needs.

"Co-parenting" after a divorce should include both parents, who communicate with each other in the best interest of their children. These same parents would think nothing unusual of co-parenting if they were still together. Only the logistics change. Reasonable communication is the key. Most cases that return to court involve some level of communication problems ranging from silence to control to interference by non parents to abusive conduct. Bottom line is the child suffers.

No matter how hotly contested some cases are, they can still be settled when everyone takes a deep breath and realizes there are always two perspectives. Every case has the potential for settlement.

This is a very busy time of year for Family lawyers. This is partly due to parents forgetting that their decisions should be for what is best for their children, as opposed to what is best for each of them.
