⚖️ PI BUZZWORD OF THE DAY: COMPARATIVE NEGLIGENCE

So, what does “comparative negligence” actually mean? 🤔

In simple terms, it means more than one person can be considered responsible for an accident.

For example: If you’re injured in a car accident but the other side argues that you were also partially at fault, your compensation could potentially be reduced based on your percentage of responsibility.

🚗 The other driver may be primarily responsible…
👀 But the insurance company might argue you played a part too.

That’s where comparative negligence comes into play.

And this is why statements like “I was partially at fault, so I can’t recover anything” aren’t necessarily true. The actual facts, applicable law, and circumstances of the case matter.

⚠️ Florida’s comparative-negligence rules have changed, so the specific date of the accident can matter when determining which rules apply.

🚗💨 SPEED KILLS.

It might only be another 10… 20… or 30 mph.

But the faster you’re traveling, the less time you have to react — and the more severe a crash can become.

According to the NHTSA, 11,288 people were killed in speeding-related crashes in 2024. Speeding was a contributing factor in 29% of all traffic fatalities that year.

And it’s not just about getting a ticket.

Speed can mean:
⏱️ Less reaction time
🛑 Longer stopping distances
💥 More severe crashes
🩹 More serious injuries

Slow down. Get there safely. Nothing is worth risking your life — or someone else’s.

🚨 Two years can make all the difference.

In Florida, there is generally a two-year statute of limitations for negligence-based personal injury claims.** That means waiting too long to take action can mean losing the ability to pursue the claim in court.

We hear it all the time:

“I thought I had more time.”

“I didn’t realize I needed an attorney yet.”

“I thought the insurance company would take care of it.”

Unfortunately, the clock doesn’t stop just because you’re still treating, negotiating with insurance, or trying to figure out what to do next.

There are exceptions and different deadlines can apply depending on the type of claim and circumstances, so **don’t assume every case has the same two-year deadline.

If you’ve been injured, knowing your deadlines early can be just as important as knowing your rights. ⚖️
