Your I-129F petition was approved by USCIS.

That is great news.

But it does not guarantee that your K-1 fiancé visa will be approved.

The consular officer at the U.S. embassy or consulate still reviews the case and decides whether the visa can be issued.

They may look closely at your relationship, immigration history, previous visa applications, documents, and answers during the interview.

Sometimes a case needs additional documents or review.

Other times, there may be concerns about whether the relationship is real or whether the foreign fiancé has an immigration issue that makes them inadmissible to the United States.

Some problems may have a waiver available. Others may be much harder to overcome.

Do not walk into your K-1 interview assuming the hardest part is already over.

If your fiancé is from Brazil, there are some important steps in the K-1 visa process that you should know before the interview in Rio de Janeiro.

First, the I-129F petition is filed with USCIS.

After approval, the case moves through the National Visa Center and then to the U.S. Consulate in Rio de Janeiro.

From there, the applicant will complete the DS-160, register the case, pay the visa fee, arrange passport delivery, complete the medical exam, and prepare for the interview.

Brazil also has an important police certificate requirement. Depending on where you have lived, you may need both federal and state police certificates.

And do not show up to the interview missing required documents. That can delay your case and may require you to schedule another appointment.

If the visa is approved, the fiancé can enter the United States. The couple then has 90 days to get married before moving into the adjustment of status process.

Did your approved I-129F petition expire before your K-1 visa interview?

Do not panic.

The I-129F petition is generally valid for four months after USCIS approves it. But because of NVC transfers, embassy processing, and interview wait times, many couples do not complete the K-1 visa process within those four months.

That does not automatically mean you have to start over.

A consular officer can extend, or revalidate, the petition so your fiancé visa case can continue.

You may need to show that you are still legally free to marry and still plan to marry within 90 days after entering the United States.

The process can vary depending on the U.S. embassy or consulate handling your case.
