A Notice of Intent to Revoke (NOIR) is one of the most frightening notices a couple can receive.

Imagine getting your I-130 approval, believing you're almost at the finish line, and then learning that immigration wants to take that approval away.

This often happens after a spouse visa interview when an officer questions whether the relationship is genuine.

A NOIR is not a simple request for more documents.

It is immigration saying they intend to revoke a prior approval and deny the case unless you successfully respond.

A couple, on our last weekly live immigration attorney chat, asked whether uploading additional photos and relationship evidence through the USCIS unsolicited evidence portal would slow down their I-130 petition.

Generally, no.

A strong case should be filed with enough evidence from the beginning. However, if your original filing was missing important relationship evidence, uploading additional bona fides may be helpful.

One thing many couples do not realize is that proving your relationship is not something you do only once.

Throughout the immigration process, you may need to prove your relationship again and again during different stages of the case.

That is why we encourage couples to continue collecting evidence throughout their journey.

Many couples think receiving a green card means the immigration process is over.

Not always.

If your spouse received a two year conditional green card, there is another step ahead called Removal of Conditions.

This process requires you to prove again that your marriage is real and ongoing.

The good news is that most couples naturally create this evidence just by living life together. Tax returns, insurance, bills, travel, photos, and other shared experiences can all help support your future application.

One thing I always remind couples is that immigration wants proof of a real relationship, not a perfect relationship. Your marriage does not have to fit into a cookie cutter mold.
