When someone passes away, their estate usually has to go through a process called probate. But what does that actually mean?

Probate is the legal process of:
πŸ“„ Validating the will (if there is one)
πŸ“‹ Identifying and inventorying assets
πŸ’° Paying outstanding debts and taxes
🏠 Distributing what's left to the rightful heirs

In North Carolina, probate is handled through the Clerk of Superior Court in the county where the person lived.

It can take months β€” sometimes longer β€” and the paperwork is no joke.

We help families navigate probate and estate administration so you can focus on what matters most.

One of the most common questions we hear from new business owners:

"Do I really need to form an LLC?"

Short answer: probably yes. Here's why:

πŸ›‘οΈ Liability protection β€” an LLC separates your personal assets from your business debts. If your business gets sued, your house isn't on the line.
πŸ’Ό Credibility β€” clients, vendors, and lenders take LLCs more seriously
🧾 Tax flexibility β€” LLCs can elect different tax treatment depending on your situation
πŸ“„ Clear structure β€” especially with partners, an LLC with a solid operating agreement sets the rules upfront

Sole proprietor with nothing to lose? Maybe you're fine. But the moment you have assets, employees, or clients β€” it's worth a conversation.

If you have a loved one with a disability, this might be one of the most important things you read today.

A special needs trust allows you to leave money or assets to someone with a disability WITHOUT disqualifying them from government benefits like Medicaid or SSI.

Here's the problem without one:
❌ You leave money directly to your loved one with a disability
❌ They're now "over the asset limit" for Medicaid and SSI
❌ They lose their benefits until that money is spent down

With a special needs trust:
βœ… The trust holds the assets
βœ… Your loved one keeps their benefits
βœ… The trust supplements β€” not replaces β€” what benefits cover

This is one area where the right planning makes an enormous difference.

Guardianship comes up a lot in our practice β€” and it's something most people don't think about until they're in the middle of a crisis.

So what is it?

Guardianship is a legal process where a court appoints someone to make decisions for a person who can no longer make decisions for themselves β€” due to age, disability, or incapacity.

There are two main types in NC:
πŸ§‘β€βš–οΈ Guardian of the Person β€” makes personal and medical decisions
πŸ’Ό Guardian of the Estate β€” manages finances and property

Guardianship can apply to adults with cognitive decline, adults with intellectual or developmental disabilities, or adults who become incapacitated due to illness or injury.

It's a serious legal responsibility β€” and the process matters. We can walk you through it.

Got a speeding ticket in North Carolina? Here's what you need to know before you just pay it and move on.

Paying a speeding ticket = pleading guilty.

And that guilty plea can:
πŸš— Add points to your DMV record
πŸ“ˆ Raise your insurance rates (sometimes significantly)
❌ Put your license at risk if you've had prior tickets

The good news? In many cases, a traffic attorney can negotiate a reduction β€” a prayer for judgment continued, a lesser charge, or even a dismissal β€” that protects your record and your insurance.

Don't pay that ticket without talking to us first.

If you or someone you love is ever arrested, these things matter:

1️⃣ You have the right to remain silent. Use it.
2️⃣ You have the right to an attorney. Ask for one β€” and don't answer questions until you have one present.
3️⃣ Be polite and cooperate physically β€” but do not answer substantive questions without counsel.

What you say in those first hours can follow you through your entire case.

We handle criminal law matters throughout the Triad. If you need help β€” or just have questions β€” we're here.

πŸΎπŸŽ™οΈ NEW EPISODE DROP: β€œWho Gets the Dog?” πŸŽ™οΈπŸΎ
This week on Motion to Spill, Sarah & Meghan are joined by one of our absolute favorites β€” family law attorney Amanda Smith β€” for a conversation that starts with pet custody… and quickly spirals into wine tolerance, hangovers, and questionable confidence about who can drink whom under the table. πŸ·πŸ˜…
✨ Chaotic? Yes.
✨ Entertaining? Absolutely.
✨ Actually informative? Surprisingly, also yes.
Here’s what you’ll learn (in between the laughs):
🐢 In North Carolina, pets are considered personal property β€” yep, legally closer to your couch than your child. That means no custody schedules or β€œbest interest” standards. Judges look at things like who paid for the pet, who cared for it, and who can provide a home.
🐾 Other states are starting to do things differently β€” some courts now consider the well-being of the animal when deciding who gets the pet.
πŸ“‘ We also get into:

Emotional support vs. service animals
Pet prenups & separation agreements
What happens when a pet ends up in a trust (yes, really)
Real-life cases including $50K dog disputes and parking lot pet exchanges 😳

And because this is Motion to Spill…
➑️ Meghan calls Sarah unfriendly
➑️ Amanda confidently claims she can outdrink everyone
➑️ Tim has a full existential moment about his Finch app bird
➑️ Sarah may or may not have forgotten her anniversary
It’s messy, it’s funny, and it’s real life with a legal twist β€” just the way we like it.

βš–οΈ Friendly reminder: this is for entertainment only β€” not legal advice.

Closing day is exciting. It can also be a LOT.

Here's a quick look at what happens at a real estate closing:

πŸ“‹ You'll review and sign a stack of documents (seriously, it's a lot of paper)
πŸ’° You'll see a final accounting of all the money β€” what you owe, what you're getting, where it all goes
πŸ”‘ Keys change hands
πŸ“ The deed gets recorded with the county

Our job is to make sure every document is right, every number adds up, and you actually understand what you're signing before you sign it.

Buying or selling in the Triad? We'd love to be your closing attorney.
