You found a construction defect years after the project was finished. Is it too late to file a claim? The answer is: it might be. In Florida, two separate clocks are running:

⏱️ Statute of limitations: generally 4 years, and the discovery rule can apply to hidden defects.

⏱️ Statute of repose: generally 7 years, starting from the earliest of the temporary certificate of occupancy, certificate of occupancy, certificate of completion, or abandonment of construction. The repose clock doesn't care when you found the defect. And a Chapter 558 notice letter doesn't pause it.

If you're seeing water intrusion, cracking, or signs of excess moistures, don't wait. Find your project dates, save your paperwork, and talk to a construction attorney before time runs out.
