A founder spends years on R&D. The patent is finally granted, and the team celebrates. Then the funding conversation begins, and the same patent that felt like a finish line becomes a question mark on a lender's spreadsheet.

A granted patent proves ownership of an idea. It does not automatically prove the idea is worth money.

When a bank or investor considers IP as security, the questions get practical very quickly:

1. How broad is the claim scope, and would it survive an invalidity challenge?
2. Is the patent enforceable against real infringers?
3. Does a live market exist for the technology?
4. Who are the likely licensees or acquirers?
5. Which valuation method holds up: cost, market or income-based?
6. If the borrower defaults, how quickly can the asset be monetised?

Land and machinery can be inspected and priced. A patent is intangible, and its value depends on legal strength, commercial relevance and liquidity all at once. That is the gap between owning IP and unlocking value from it.

India is filing more patents every year, but the next phase is not about volume alone. It is about making IP visible, measurable, transferable and bankable. Where a technology has real commercial traction, a patent should be able to function as a financial asset, not just a certificate in a portfolio.

A patent can be granted and still quietly lose value.

Most teams celebrate the grant date. Fewer go back and check how many days of term they actually walked away with.

Patent Term Adjustment (PTA) is meant to compensate for certain USPTO delays during prosecution. In practice, though, it's often treated as paperwork: something to "look at later" or leave to a standard calculation printed on the notice of allowance.

Here's why that's risky.

1. USPTO delays (A-delay, B-delay, and C-delay)
2. Overlap between delay periods
3. Applicant delay, such as late responses or filings that reduce the adjustment
4. Terminal disclaimers that can cap the benefit
5. Timely review of the PTA determination before the window to challenge it closes

1. A miscalculated PTA
2. A shorter effective patent term
3. Fewer days of exclusivity
4. A weaker negotiating position in licensing and enforcement
5. Potentially millions in unrealized value

For a high-value pharma, semiconductor, or AI patent, one day is not just one day. It's one more day of market exclusivity. When the protected product generates millions in annual revenue, those days add up fast.

1. Independent PTA analysis, not just accepting the USPTO's number
2. Proactive docket management across prosecution timelines
3. Rigorous tracking of response deadlines to avoid avoidable applicant delay
4. Timely review and, where warranted, challenge of PTA determinations

The question for IP leaders: Is PTA getting the strategic attention it deserves in your portfolio, or only when something goes wrong?

If your team hasn't audited PTA across your key patents recently, it may be worth doing before the window closes. Let's talk.

Aspirin is also acetylsalicylic acid. It's also 2-acetoxybenzoic acid. It's also CAS 50-78-2.

Same molecule, three identifiers. A keyword search will happily miss two of them.

That's the quiet flaw in a lot of prior art and freedom-to-operate (FTO) work. Text search finds words. Structure search finds molecules.

A single Markush claim uses variable groups (Rยน, Rยฒ, Rยณ) to cover thousands, sometimes millions, of compounds, many never named in the patent. Your molecule can sit inside someone else's claim without ever appearing in the text.

The tool is the easy part. The hard part is interpreting the hit: is it within the claim scope or just the disclosure? Is the patent in force, and where?

That's a legal question about wearing a chemistry costume.

Happy National Day, China!

Today, October 1st, marks the founding of the People's Republic of China. It's a day to celebrate a nation that has shaped global trade, technology, and culture in ways we all feel every single day.

Working across borders has taught us that the strongest partnerships are built on trust, respect, and a genuine willingness to understand each other's perspectives. Those values guide how we serve every client, in every jurisdiction.

To everyone marking this occasion: we hope you enjoy a joyful holiday, quality time with family, and a wonderful Golden Week.

Here's to continued collaboration, sound counsel, and shared success ahead.

Everyone pictures a cease-and-desist letter. That's the cheap part.

The expensive part: a weak name quietly ties your reputation to a company you've never met. Their bad reviews become your problem. Their lawsuit shows up in your search results.

Three things the usual advice skips:

They reach the Principal Register only with proof of acquired distinctiveness, years of evidence and spend. Generic terms never register. Invented words are cheaper to protect.

A larger company adopts a similar mark, saturates the market, and customers assume you copied them. Actionable in U.S. courts, but the reputational damage lands years before any ruling.

Willful infringement can mean disgorgement of profits, damages up to three times actual, and attorney's fees in exceptional cases. And a clean USPTO search isn't enough, U.S. rights arise from use in commerce, while most of the world is first-to-file. Filing after you expand is filing too late.

Naming is a legal decision with a creative step attached. Not the reverse.

Virtue Legal Services runs full clearance and builds a filing strategy that matches where you're headed.

Two keys. One second. Zero rights transferred.

Everyone's seen it happen. A product does well, and within weeks, three "inspired" versions show up. Same colours. Same tagline energy. Same "look and feel." Different names, maybe.
The logic feels simple: if it works, why reinvent it?

Except intellectual property doesn't run on "why reinvent it" logic. It runs on "who actually owns this."

And here's the part most people miss:

That gap is exactly where IP law lives. Not in paperwork โ€” in questions like:
โ†’ What was actually created? โ†’ Who legally owns it? โ†’ What's protected, and what isn't? โ†’ What rights does that protection actually give you? โ†’ And has anything really been copied, or just... inspired?

Ctrl+C takes one second.

Knowing what you're allowed to copy, license, build on, or protect takes a little more than a keyboard shortcut.

That's the part worth getting right before it turns into a dispute instead of a decision.

Building something original? Make sure the law protects it as tightly as you built it.

Talk to Virtue Legal Services about trademarks, patents, copyrights, and design protection โ€” before someone else hits Ctrl+C on your work.

Two completely different IP rights can protect the same product design. Most people don't realize this until they're in litigation.

A design patent protects how something looks; it has to be new, original, and non-obvious, is examined by the USPTO, and lasts 15 years.

Trade dress protects something else: the look and feel that tells customers who made it. Nobody examines it upfront. It's earned through years of use, and it can last indefinitely, as long as it stays distinctive.

1. File the design patent early, before the product has any track record (there's no secondary meaning yet, so there's no trade dress to claim).

2. Spend the 15-year patent term building recognition.

3. By the time the patent expires, the design has often become distinctive
enough to carry trade dress protection forward on its own.

It's the same reason the Coca-Cola bottle is still protected today, decades after its original design patent expired.

Here's where it gets contentious in court: both protections can be defeated by the same argument, functionality. If a feature is ruled functional rather than purely ornamental, neither claim survives. But the functionality test isn't identical for each doctrine, which is exactly why plaintiffs increasingly plead both together (see Apple v. Samsung, Columbia Sportswear v. Seirus).

For anyone building an IP strategy around a product's design, or defending against one, this overlap isn't a technicality. It shapes what you file, when you file it, and what leverage you still have after the patent runs out.

How is your team thinking about layering design patents with trade dress? Virtue Legal Services would love to hear different takes on the sequencing.

When Walmart's "Wirkin" bag went viral on TikTok this year, the price gap wasn't what caught people's attention, it was how closely the shape mirrored Hermรจs' Birkin, a bag whose exact contours have been fought over in court for years.

Nobody accused Walmart of stitching a fake logo onto anything. That was never the issue. The debate was about something harder to draw a line around: the shape itself, the proportions, the way people recognize a bag from ten feet away without ever seeing a nameplate.

This is where dupe culture and intellectual property law actually collide.

A product doesn't need to copy every detail to raise a legal question. What matters is the overall impression, the silhouette, the proportions, the details a consumer's eye locks onto before they even register the price tag. Courts look at whether an ordinary buyer could reasonably associate the copy with the original brand, even without a single shared logo.

For brands like Hermรจs, the Birkin's shape has been treated in past disputes as something closer to a signature than a design choice, the flap, the frame, the handle placement all work together to signal exactly whose bag it is. Protecting that identity means going beyond the name stitched inside.

IP Insight: Dupe culture sits exactly at the friction point between accessibility and originality. Shoppers want the look without the price. Brands want to protect the specific details that make a design theirs, even the details nobody consciously notices until they're missing.

So, tribute to a design people love, or a step too close to the original? Where do you draw the line?

LABUBU: THE TOY TREND THAT BECAME AN IP CASE STUDY

In 2025, everyone was talking about as a toy trend. Almost nobody's talking about it as an IP case study, and it's one of the cleanest examples of brand protection done right that we've seen in 2025.

Here's the fast version:
Artist Kasing Lung created Labubu as part of "The Monsters" character series, then licensed it to Pop Mart for global toy production. As the doll went viral, so did the counterfeits; cheap look-alikes now nicknamed "Lafufu" flooded convenience stores, marketplaces, and airports.

Pop Mart didn't just watch it happen. It had already done the unglamorous work years earlier: registering the LABUBU wordmark, THE MONSTERS composite mark, trade dress covering the doll's actual look and packaging, and copyrights on the blind-box artwork itself. That paperwork is what turned "someone's copying us" into an actual lawsuit.

In July 2025, Pop Mart filed a 144-page complaint against 7-Eleven and several California franchisees, stacking 17 causes of action, trademark counterfeiting, trade dress infringement, copyright infringement, and unfair competition, and going after the parent company too, not just the stores. By September 2025, a federal court granted a temporary restraining order in Pop Mart's favor on nearly every point, including rejecting the "gray market goods" defense outright.
Around the same time, U.S. Customs and Border Protection seized over 11,000 counterfeit Labubu products in a single operation at Seattle airport.

The lesson for any brand sitting on a hot product: enforcement only works because the registration work happened first. You can't sue your way out of a gap you never closed.

If your product is gaining traction, or you're worried it soon will, this is the moment to check what's actually protected. Talk to about a trademark and IP audit before a competitor, counterfeiter, or courtroom forces the conversation.
