Adrienne Davis of MGD Law will be moderating a panel on drafting and planning for retirement benefits with ACTEC Fellows, Steve Gorin and Kathy Sherby, at the 2025 Annual Estate, Trust, and Elder Law Institute on November 7 at 1:10 p.m.

There will also be a session on the recently enacted Missouri Electronic Wills and Estate Planning Documents Act. Adrienne Davis served as Vice Chair of the subcommittee that drafted this important piece of legislation.

Important Corporate Transparency Act Update as of December 26, 2024.

On December 26, 2024, the merits panel of the 5th Circuit Court of Appeals VACATED the December 23, 2024 decision by the motions panel that lifted the nationwide injunction, effectively reinstating the nationwide injunction on FinCEN's ability to enforce the BOI report filing deadline.

FinCEN has just released an update noting that submission of BOI reports is again voluntary while the order remains in effect.

On Friday, December 6, 2024, FinCEN issued a response to the nationwide preliminary injunction halting the enforcement of the Corporate Transparency Act (CTA). For the time being, filings are voluntary rather than mandatory, deadlines are suspended, and penalties will not be enforced due to ongoing litigation. Please see our article for more information. MGD Law will continue to monitor developments and provide updates. Please be sure to follow our page to stay informed.

On December 3, 2024, the U.S. District Court for the Eastern District of Texas provided nationwide temporary injunctive relief from having to comply with the January 1, 2025 deadline to file certain Beneficial Ownership Information (BOI) Reports required by the Corporate Transparency Act (CTA).

Yesterday, December 3, 2024, a Texas federal district court provided the entire country with nationwide temporary injunctive relief from having to comply with the January 1, 2025 deadline to file certain Beneficial Ownership Information (BOI) Reports required by the Corporate Transparency Act (CTA). See the article link for more discussion on the nationwide injunction. MGD Law is monitoring developments and will provide further guidance to MGD clients.

The Corporate Transparency Act and its implementing regulations, which require US business entities to report stakeholder information to the Treasury Department, were preliminarily blocked nationwide by a Texas federal court on Tuesday.

Many of our clients make charitable giving a significant component of their estate plan, and we love being part of that process.

There are numerous options when it comes to giving-

-Making Qualified Charitable Distributions from a retirement account

-Donating highly appreciated securities

-Naming charities as beneficiaries on retirement accounts

-Creating a Private Foundation or using a Donor Advised Fund to create a charitable legacy

-Specific bequests in your Revocable Trust

-Irrevocable Trusts that have a charitable purpose

While everything mentioned so far has to do with money, your time is also extremely valuable. Giving money isn’t the only way to make a difference!
