NOT GUILTY!

Caleb secured a full acquittal for a client charged with felonious assault, a second-degree felony carrying a potential prison sentence of up to 12 years.

The allegation involved an injury in which the complaining witness lost part of a finger. At trial, Caleb presented evidence showing that the client had first been maced, then tackled to the ground, and was assaulted while on the ground. This evidence told a very different story than the prosecution’s version of events.

After trial, the self-defense claim prevailed, and the client was fully acquitted of the charge.

We are grateful for the verdict, for the client’s trust, and proud of the Client for their resilience throughout the process. The weight and gravity of these types of charges can often lead a client to take a plea to a lesser offense; however, the attorney-client communication and trust created the confidence to stand up and fight!

NOT GUILTY!

Recently, Caleb won a full acquittal. The client was charged with felonious assault and domestic violence. The felonious assault was a second degree felony, punishable up to 12 years in prison, and the domestic violence was a first degree misdemeanor. Both charges originated from the same incident. The client had a very minimal record prior to these charges and had no history of violence. Client was stabbed 3 times during the incident; however client was still charged with these allegations. Caleb was able to show that Client acted in self defense AFTER he was stabbed. Client was acquitted on all charges.

We are grateful for the verdict, for the client’s trust, and proud of the Client for their resilience throughout the process. NOT GUILTY!

Last week, Correna won a full acquittal after a three-day jury trial in Municipal Court. The client was charged with obstruction of official business and resisting arrest. Both charges are misdemeanors of the second degree, each carrying up to 90 days in jail. The client was tased multiple times during the incident. After hearing the officer’s testimony and aggressive cross examination by Correna, the jury deliberated for about five hours before finding the client Not Guilty of both charges.

We are grateful for the verdict, for the client’s trust, and for the jurors who took time out of their busy lives to carefully consider this matter and come to the right decision.

Dedicated representation is about more than just skillful litigation. On March 27th, Correna gained a client who had been arrested on two misdemeanors in downtown Cincinnati on Opening Day. Though the incident did not occur at the Banks or as part of any Opening Day event, this client was lumped in with the other "Opening Day cases" and received a bond of $30,000 secured (no 10%) in spite of his minimal criminal history and low-level allegations. Correna spent the following six days working to get his bond reduced: advocating for the client with judges, prosecutors, and the Bail Project, and even filing a challenge to the excessive bond in the First District Court of Appeals. Ultimately, Correna persevered and the client’s bond was reduced significantly, then the balance was immediately paid by the Bail Project, releasing the client from jail just over a week after he was arrested.

On April 14th, Correna represented her client at a bench trial in Hamilton County Municipal Court where he was acquitted of both allegations.

The “not guilty” verdicts were a huge victory for the client, but minimizing the time he had to spend in the Justice Center by working as quickly as possible to address his bond was just as crucial to his family, his employment, and his wellbeing.
