Ohio's sentencing framework favors alternatives for many first-time offenders. For fourth and fifth-degree felonies, community control is presumed unless aggravating factors apply. Without a prior record, factors suggesting reoffending risk often don't exist, opening doors to community-based alternatives.

One thing that helps: document everything positive. Employment history, community involvement, education, family responsibilities. Your attorney can present this as mitigating evidence during sentencing.

Fact: In Ohio, you can still pursue compensation as long as your fault doesn't exceed 50%. Under Ohio's modified comparative negligence system, your damages are reduced by your percentage of responsibility, but partial fault doesn't automatically disqualify your claim.

Think you're safe from OVI charges because you weren't driving? Ohio law says otherwise.

Many don't realize that falling asleep in your vehicle after a night out, engine running, keys in the ignition, can result in criminal charges. Ohio distinguishes between "operating" and "driving," and courts interpret this broadly.

Two legal theories apply: prosecutors may argue you were "operating" the vehicle, or cite Ohio's "physical control" statute covering impaired individuals who could set a vehicle in motion.

Don't assume a parked car means an open-and-shut case against you.
