A CRY FOR JUSTICE!!

Client’s vehicle was stalled on the freeway due to mechanical failure when he was rear-ended by a tractor truck that was traveling 60 MPH. Client suffered catastrophic injuries, required multiple surgeries and is now a paraplegic. After the traffic collision, while in the hospital, the CHP subjected client to a DUI investigation, and client was cited for DUI. His blood alcohol content on the night of the collision was 0.18%. The defense used the client’s DUI arrest as a basis for denial of his personal injury claim even though his vehicle was rear-ended while the client was stalled on the freeway. Facing criminal charges for the DUI, denial of his personal injury claim, no source of income, requiring 24/7 care, and relegated to a wheelchair for the rest of his life, client’s family reached out to the Madrid Law Firm. Team Madrid answered the call and went on the attack. Team Madrid secured a dismissal of the DUI charges, which paved the way for a civil lawsuit. The defense asserted that alcohol was the cause of accident, which Team Madrid vigorously disputed and prepared for a showdown. Team Madrid hired their experts and prepared the case for trial. As part of their trial preparation, Team Madrid conducted two mock trials. On the eve of trial, Team Madrid obtained a favorable settlement for their client. Client will be financially supported for the rest of his life. By the grace of God on their side, justice prevailed!

TEAM MADRID’S CRIMINAL DEFENSE BACKGROUND IS AN ASSET IN CIVIL MATTERS!

Our clients, husband and wife, were victims of a rear-end traffic collision with a drunk driver. The driver stated to the police that he had consumed “1 or 2 palomas” (tequila and sq**rt) prior to the collision. The insurance carrier took the position that the defendant driver’s blood alcohol concentration (BAC) was “minimal” and “irrelevant.” The insurance company offered nuisance value to settle the matter. Team Madrid filed a civil lawsuit for damages against the drunk driver. The insurance defense attorney obstructed all discovery efforts with regard to the drunk driver’s level of intoxication. Team Madrid issued a subpoena for the crime lab records and took the deposition of the criminalist who analyzed the drunk driver’s blood. The criminalist testified that the driver’s BAC was 0.18% at the time of the blood draw, and a 0.23% at the time of the traffic collision. The criminalist opined that to reach that level of blood alcohol concentration, the drunk driver would have had to consume 12.1 ounces of tequila. After the deposition, Team Madrid moved to amend the complaint to add a claim for punitive damages. On the eve of the motion, the carrier offered their 6-figure policy limits. Justice prevailed!

NO ONE IS ABOVE THE LAW!

Client was standing by his vehicle at home behind a closed gate when two policemen on foot barged through his gate yelling, “Get Down Mother F****ER!” One officer struck our client in his face with a closed fist knocking him down to the ground. The other officer pinned our client down on the ground with his knee and handcuffed him. Both officers lifted our client off the ground while still handcuffed. Client was taken outside of his property where a crowd had gathered. The alleged victim ran up and said, “You have the wrong guy!” Prior to this time, the police had been called to an adjoining strip mall where a person had assaulted and battered the alleged victim and broke the windows of his vehicle. When the police arrived, the alleged victim pointed in the general direction of our client’s residence but offered no identification details of the alleged perpetrator nor did the officers ask. Rather, the officers ran towards the gate of our client’s residence, which was ajar, pushed the gate open, entered and attacked our client. Our client was taken by ambulance to a local hospital with a broken nose and bleeding from the face. The police officers' own department’s use of force investigation found that the officers did “nothing wrong,” did not discipline them and found that the entry of the client’s home and ensuing assault and battery committed by the two officers was within policy guidelines. MLF filed a federal civil rights action against the police officers, and the City. The parties participated in a settlement conference with a United States Magistrate Judge, which lead to a substantial settlement. The moral of the story: “No One Is Above The Law!”

“OPEN SESAME,” SAID THE JUDGE!!

Team Madrid represented three families who own land-locked parcels of land. Their only way of access to their respective properties is through a road that traverses their neighbor’s property. The neighbor closed off and barricaded the road, and built an alternate route that was inherently unsafe to traverse. The three families retained the Madrid Law Firm to file a Complaint for Injunctive Relief and to Quiet Title to a Prescriptive Easement. The neighbor hired a “Real Estate” attorney/specialist. After a four (4) day bench trial, judgment was entered in favor of Team Madrid’s clients. The Court ruled that Team Madrid’s clients had established a Prescriptive Easement and ordered neighbor-landowner to open up access to the road. Although the Madrid Law Firm does not handle or specialize in real estate matters, Team Madrid is dedicated to helping their clients with their legal needs regardless of the field or what their opponents choose to call themselves. A lion never has to tell anyone he is a lion!
