Hi Friend,

Two early probate milestones tend to reduce confusion:

1) Opening probate (typical 30–60 days):
The executor (or an interested party if there’s no will) usually files a petition to open probate and be appointed. The article notes this is generally expected within 30–60 days, even if there’s no hard statutory deadline mentioned there.

2) Notice to heirs and legatees (within 14 days after appointment):
After appointment, the executor/administrator must send written notice to heirs and named beneficiaries within 14 days. This notice includes the case number, court location, and rights around receiving future notices.

If you’re an heir and you’re unsure whether probate has been opened yet, it’s reasonable to ask:

“Has the petition been filed?”

“Do we have a case number?”

“When will notices go out?”

Reply “NOTICE” if you want a simple message you can send to the executor to request the basics (politely and clearly).

If someone has the will, Illinois expects it to be filed quickly.

A common early snag in probate is surprisingly simple: where the will is—and who has it.

In Illinois, the law notes that whoever has the will is expected to file the original document with the circuit court clerk in the county where the person last resided within 30 days of learning of the death.

Missing that deadline can create major delays and legal complications.

A Practical 3-Step Approach:

Locate the Original: Check home safes, file cabinets, the drafting attorney’s office, or their bank box.

Make copies: Scan a digital copy and make paper copies for the family record before you give the original to the court.

File it: Confirm it gets filed with the correct county clerk (e.g., Cook, Lake, DuPage).

If a home is involved, this one step often affects everything that follows—the legal timing, who has access to the property, and what can be done with it next.

1. Within 30 Days of Learning of Death: File the Will

4. Within 60 Days After Appointment: Inventory Filing

Will Contest Deadline: Heirs or interested parties have 6 months from the date the will is officially admitted to probate to file a challenge. Challenges are typically barred after this time.

6. Varies by Case: Final Accounting + Distribution (Closing the Estate)

Action: There is no fixed deadline for closing the estate. The timing depends on court schedules, complex asset distribution, or resolving debts and taxes. However, heirs can petition the court if the process is unreasonably delayed.
