AERO SWIFT SENIOR LEGAL CONSULTANT FILES FEDERAL LAWSUIT AGAINST IMOTORSPORTS, INC. FOR ADA VIOLATIONS AND CONSUMER FRAUD

Rebekah Brewis, Senior Legal Consultant at Aero Swift Legal Consultants, has filed a federal lawsuit in the United States District Court for the Northern District of Illinois against iMotorsports, Inc., an Elmhurst-based motorcycle dealership. The complaint alleges violations of the Americans with Disabilities Act, the Illinois Human Rights Act, and the Illinois Consumer Fraud and Deceptive Business Practices Act, among other claims.

The lawsuit arises from the October 2025 purchase of a 2025 Yamaha MT-07 motorcycle, in which the dealership allegedly delivered a vehicle with a different Vehicle Identification Number than the one documented on the Illinois Certificate of Title. This VIN mismatch created immediate title defects and insurance fraud exposure for the purchaser.

Central to the complaint are allegations that iMotorsports repeatedly ignored explicit requests for disability accommodations. Prior to the transaction, Ms. Brewis formally requested email-only communication as a reasonable accommodation for autism-related verbal communication difficulties and other disabilities. Despite this documented request, dealership personnel allegedly placed numerous unauthorized phone calls and refused to respond to written settlement demands, in direct violation of ADA Title III requirements for places of public accommodation.

"This case is about more than recovering financial damages," said Ms. Brewis. "It is about holding businesses accountable when they ignore the accommodation needs of customers with disabilities and engage in fraudulent sales practices. Every consumer deserves to be treated with dignity and to receive what they paid for."

The seven-count complaint seeks $295,000 in damages, including compensatory damages, treble damages under the Illinois Consumer Fraud Act, punitive damages, injunctive relief requiring ADA compliance, and attorneys' fees. A jury trial has been demanded.
