This summer, we were lucky to have Camila Moreno Niño with us as a legal intern.

Camila is a pre-law student at Indiana University's O'Neill School of Public and Environmental Affairs, studying Law and Public Affairs. She has a bright road ahead of her, and wherever she goes next, the people she works with will be fortunate, the way we were.

If you are waiting for a "better time" to ask about SIJS for a young person in your care, this is the post we most want you to read.

Most people know Special Immigrant Juvenile Status has an age ceiling: the petition has to be filed while the young person is under 21 and unmarried.

But that is usually not the deadline that ends a case.

SIJS requires findings from an Illinois state court first, and that court has to still have authority over the young person's case in order to make them. Depending on the type of case, that authority can end earlier than the federal age limit does.

In plain terms: a young person can be comfortably under 21 and already be out of time.

This is the one door that does not reopen. There is no late filing. A situation that was strong a few years ago can quietly be gone, without anyone doing anything wrong. *

So if a young person in your life fits this picture, the most useful thing is not to wait for more certainty. It is to ask early, while there are still options to choose between. We will tell you honestly whether SIJS fits, whether something else fits better or alongside it, and what a realistic path looks like for that specific young person. Sometimes the answer is that there is no case. That answer is worth having early too.

It is for immigrant young people who cannot safely go back to a parent because of abuse, abandonment, or neglect.

Here is what makes it different from most immigration cases. SIJS runs through two courts, not one. It starts in an Illinois state court, and then goes to federal immigration authorities. Both steps have to line up correctly, which is a big part of why families do this with a licensed immigration attorney rather than on their own. *
