Founding and Managing Partner Gerald J. Bekkerman recently secured a settlement for a client injured in an automobile crash in 2024 who sustained a broken hip, requiring a hip replacement. The insurance company for the at fault driver offered only $100k in insurance limits to settle. Gerald was able to creatively argue that the defendant was in the course and scope of his employment at the time of the crash, despite admittedly leaving his office to go home for the day. The case involved nuanced issues of agency and employer/employee liability. After prevailing through numerous contested motions, the employer paid an additional $2.2 million to settle the case on the eve of trial.

Taxman, Po***ck & Bekkerman is proud to share Partner James P. Lynch and Associate Jack S. Rubin’s recent $1.1 million policy-limits settlement for the family of a 59-year-old West Chicago man, who tragically lost his life in a roadway incident in Kane County, Illinois. The man was struck and killed while attempting to assist an injured animal in the roadway. The case involved a work vehicle operated by employees acting within the scope of their employment, raising significant issues of negligence and corporate responsibility. Through diligent investigation and advocacy, Mr. Lynch and Mr. Rubin secured a full policy limits recovery, specifically $1,000,000 from the primary defendant’s insurer and additional payment from a secondary defendant. TP&B is honored to have represented this man’s family during an incredibly difficult time.

TP&B Partner Bradley N. Po***ck secured a $12 million settlement on behalf of a 28-year-old man who suffered fractures and a degloving injury to his left lower leg during a workplace forklift crash.

Plaintiff, a temp agency employee, was placed for short-term assignment, in a general labor role, at a Kane County distribution warehouse operated by Defendant. Defendant had Plaintiff operate a stand-up forklift, machinery requiring specific training and certification. Plaintiff was not certified and received minimal training. Shortly after beginning operation, Plaintiff lost control of the forklift and crashed, pinning his left lower leg between the machine and a bollard. Plaintiff sustained fractures to his left tibia and fibula at the ankle and a degloving injury to his lower leg. The Defendant disputed liability and argued, among other defenses, that Plaintiff was its “borrowed employee,” claiming protection under Illinois Workers’ Compensation law.

This is the largest settlement secured in Kane County, surpassing the previous record of $7.5 million set in 2012. Plaintiff also secured a $192,000.00 reduction in his workers’ compensation lien. Kane County Circuit Court Judge John G. Dalton presided over the litigation. Hon. F. Keith Brown (Ret.) was instrumental in reaching resolution.

Cameron J. Tober and Gerald J. Bekkerman secured a settlement of 5.22M and a full workers' compensation lien waiver for a 52-year-old laborer whose foot and ankle were severely injured when a slab of granite fell on his leg at his workplace. They brought a products liability case alleging a design defect and failure to warn or instruct on proper use of the large industrial machinery holding the granite slab. Confidential manufacturers/designers of said machinery and its software paid.
