On Monday, Elizabeth Fegan and Georgia Zacest of Fegan Scott LLP will begin trial on behalf of the family of Brandon Pace against Centurion of Missouri, LLC and others arising from Brandon's death while in custody at Tipton Correctional Center in Missouri.

Brandon was a son, a father, and a person whose life mattered deeply to those who loved him. His mother, Tammy Reed, and Brandon's children have waited more than three years for the opportunity to present the evidence to a jury.

This case concerns the medical care provided to an individual in state custody and the fundamental principle that every person—regardless of their circumstances—is entitled to constitutionally adequate medical care and human dignity.

Today, the Hamilton Circuit Court in Indiana certified a statewide class of Indiana residents who used Roundup for agricultural or commercial purposes and who face an increased risk of developing non-Hodgkin lymphoma but have not yet been diagnosed with the disease.

"This ruling recognizes that Indiana Roundup users who face an increased risk of Non-Hodgkins Lymphoma deserve the opportunity to pursue medical monitoring as a class and to protect their rights before those rights are extinguished," said Elizabeth Fegan, Managing Partner of Fegan Scott LLP and class counsel, together with William Riley of Riley Cate.

The certification order comes as a proposed settlement pending in Missouri state court seeks to resolve and release certain future claims involving Roundup users who have not been diagnosed with non-Hodgkin lymphoma without any consideration. The Indiana Class intends to take all necessary steps to ensure that their rights, as recognized by today's order, are not extinguished or compromised through proceedings in another jurisdiction without their consent or adequate protection.

"Indiana courts have now recognized that these claims belong to Indiana citizens and may proceed on a class-wide basis in Indiana," Ms. Fegan added. "There is something profoundly wrong about asking Indiana citizens who face a materially increased risk of cancer to surrender their rights for free. A person does not have to wait for an NHL diagnosis before their interests deserve protection. The Indiana Class has been exposed, faces real health risks, will incur costs to monitor their health due to those risks, and now has a certified class recognized by an Indiana court. We will not stand by while those rights are bargained away for no consideration in another state."

The Indiana action seeks the establishment of a medical monitoring program for qualifying Roundup users to facilitate early detection and treatment of non-Hodgkin lymphoma and other related conditions allegedly associated with exposure to glyphosate-based herbicides.

As we reflect on Juneteenth, we think about a simple but powerful truth: rights that exist on paper mean little if they are not recognized, enforced, and protected in practice.

The reality of Juneteenth reminds us that emancipation was not fully realized when the law was written. Freedom required people willing to act—to insist that the promises embodied in the law become reality. That lesson remains relevant today.

We also filed our motion for summary judgment in a decade-long case against CVS alleging inflated prices for generic prescription drugs. And as July approaches, our team is working tirelessly to prepare for trial against the Missouri Department of Corrections and Centurion arising from the death of Brandon Pace in custody.

⚖️ Significant Court Victory in the Case of Brandon Pace



A federal court has ruled that key claims in our lawsuit over the death of Brandon Pace will move forward to trial.



Mr. Pace died while incarcerated at Missouri’s Tipton Correctional Center after ingesting a substance, being pepper sprayed, and receiving grossly inadequate medical care. In a substantial ruling, the Court found that a jury should decide whether medical personnel were deliberately indifferent to his serious medical needs and whether Centurion, the prison's healthcare provider, and its nursing staff failed to properly train staff and maintain constitutional practices.



Claims including deliberate indifference, failure to train, wrongful death, loss of chance of recovery, and punitive damages will now proceed to trial in July 2026.

FeganScott is launching an investigation into the St. Anthony’s Hospital data breach that occurred on or around February 27, 2025. St. Anthony’s Hospital is a Chicago, Illinois-based community hospital providing care to southwest Chicago.

More than a year later, on on March 6, 2026, St. Anthony’s Hospital publicly disclosed that an unauthorized third party had gained access to parts of its network containing personally identifiable information stored in the hospital’s email systems.

The hospital finished its investigation on February 13, 2026, and began sending notice to affected individuals on March 6, 2026.

FeganScott is launching an investigation into the Sagent Pharmaceuticals (SagentPharma) data breach that occurred on or around February 11, 2026. Sagent Pharmaceuticals is a Schaumburg, Illinois-based generic pharmaceuticals provider, offering a large catalogue of pharmaceutical products to healthcare providers and patients.

SagentPharma sent written notification to affected individuals on April 17, 2026 that an unauthorized third party had gained access to parts of its network containing personally identifying information of over 1,000 customers.

The company discovered the data breach on March 23, 2026, over a month after the actual breach occurred.
