A major step forward for PVC pipe purchasers.
This week brought two important developments in the nationwide PVC Pipe Antitrust Litigation for the End User Class, led by Elizabeth Fegan of Fegan Scott LLP.
Yesterday, the Court largely denied defendants’ motions to dismiss, allowing the core antitrust claims to move forward. The End User Plaintiff Class alleges that major PVC pipe manufacturers used a private industry publication and communications with its reporter to exchange confidential pricing information, coordinate price increases and discounts, and monitor whether competitors were “holding the line.”
And today, the Court granted final approval of the End-User Class settlements with Atkore and Otter Tail, providing $80 million in total relief — $50 million from Atkore and $30 million from Otter Tail — plus cooperation that will support the ongoing case against the remaining defendants.

These are meaningful milestones for the class, and the litigation continues.
