IMPORTANT & TIME-SENSITIVE: New Version of the I-864 Published by USCIS – NO Grace Period
On August 31st, USCIS published a new edition of Form I-864, Affidavit of Support, with an edition date of August 24, 2026. USCIS will not provide a grace period and will only accept this edition of the form beginning August 31, 2026. Old editions will be rejected with no grace period.

New Public Charge Guidance to Take Effect on September 18, 2026

USCIS is updating its “public charge” guidance effective Sept. 18, 2026. The new guidance explains who is subject to public charge inadmissibility grounds, the factors USCIS will consider, including age, health, family status, finances, education, and skills, and how certain public benefits may be evaluated. Some immigration categories remain exempt, and eligible applicants may be invited to post a public charge bond. The guidance applies to covered Form I-485 applications submitted on or after Sept. 18th. The U.S. Department of State has established a new Birth Tourism Prevention Task Force to combat the alleged misuse of nonimmigrant visas.

Working with DHS, the Task Force is identifying birth-tourism activity, targeting networks that profit from it, and taking action against visa holders who abuse the visa process. The Department reports that more than 600 visas have already been revoked as part of these efforts. The announcement also highlights cases involving misrepresentation of travel purposes, falsified or concealed information, and other efforts to circumvent U.S. immigration laws.

The task force is reviewing visa-holder activity and travel histories and coordinating information with DHS and other federal agencies. The Department says it is working to identify and dismantle for-profit networks that facilitate birth tourism, including those allegedly involved in visa coaching or misrepresenting travel purposes.
