Yes, it is definitely true that you can put things in a parenting plan that are impossible to prove or are too micro-managey. But there are so many gems that actually work and will keep you OUT of court.

The key is to be specific and to include things that are measurable and/or self-executing like the summer vacation language that says if other parent fails to provide their dates by a deadline, you can lock in your dates.

These are the types of things I bring up with my mediation and divorce clients. And there are so many more!

If you can do this method (not everyone is a candidate) collaborative divorce is an incredible way to handle a complex divorce.

Instead of going to court, each spouse hires a collaborative lawyer who work TOGETHER to resolve the case.

No grandstanding. No intentional delays. No withholding of financial info.

A divorce coach is built into the process, helping to smooth out conflict and help with communication, especially when kids are involved.

A financial professional is used by both parties to gather and analyze financial information and educate them about their options and the tax consequences of division.

Do I need to bring atty to mediation: It is not required to have an attorney when you’re going through divorce mediation.

Honestly, as a divorce attorney and mediator myself, I think it can often be too many cooks in the kitchen when both parties bring attorneys. It’s also really expensive.

Every situation is different but I think a great way to mediate is for both sides to have attorneys that they talk to on the side, start with parenting issues and tackle finances second, and bring the lawyers in for the final session if needed to help finalize the last few issues.

Again, every situation is different and sometimes you need lawyers from beginning because the issues are so complex or a party requires more support (like if you are afraid your spouse will intimidate/railroad you)

When I work with clients as a mediator, I structure the sessions to custom meet the needs of that couple. And I will give the parties advice about whether they should bring an attorney or not.

And that’s just how I like it. Here’s why: I was doing a divorce trial once and the other lawyer said something absolutely insane to me in the hallway.

The parties had been in court for years and had spent over 200k. I represented Dad and Mom’s attorney was essentially arguing that he should have no parenting time (despite the court and the GAL both clearly telling her they saw no reason to restrict Dad’s time at all.)

This expensive trial was completely unnecessary. We were in the hallway on a break when I asked the other attorney “why are you doing this?” Why waste all of the parties’ money and drain their retirement?

Even though his client was standing right there, the attorney laughed. He said there was a lot of money to make in this case and since the children were still young we had years to go to make a profit.

We won that trial. But the parties could have had a similar result for 10k if they had both worked with smart, amicable attorneys or a mediator from the get go.

I never forgot that moment in the hallway. And a few months later, I signed up for a mediation training course.

I would rather work on a dozen mediation cases where I help families resolve their case for less money, with a better more personalized result then a trial that costs my client their life savings.

Those happy clients refer their friends to me. Our business has not suffered, it has grown.

We need the courts sometimes. But many more cases can be resolved out of court with smart negotiation and well-chosen professionals who want to save your money, not collect it.
