Carroll Walker never downloaded Uber’s app. He never created an Uber account. He never saw or agreed to Uber’s Terms of Use.

His wife arranged a guest ride for him. During that ride, the driver allegedly went the wrong way down a one-way street, causing a catastrophic crash that ultimately resulted in Walker losing both legs above the knee.

When Walker sued, Uber argued that he was nevertheless bound by its arbitration provision because it had sent a text message containing a link to its terms.

The D.C. Circuit disagreed.

Calls for greater “transparency” around third-party litigation funding are intensifying. But when does disclosure serve a legitimate procedural purpose—and when does it simply give one side a strategic advantage?

In his latest Arguing Class Actions column for The National Law Journal, DiCello Levitt Founding Partner Adam Levitt examines proposals to require plaintiffs using litigation funding to turn their financing agreements over to opposing counsel.

Adam argues that courts already have the tools to require targeted disclosure when the facts warrant it. Automatic production of funding agreements risks exposing strategically valuable information without first establishing relevance.

DiCello Levitt and co-counsel have filed a proposed antitrust class action on behalf of the City of Baltimore against Bausch Health and its Salix Pharmaceuticals subsidiaries over the prescription antibiotic Xifaxan.

The lawsuit alleges Bausch engaged in a years-long effort to delay lower-cost generic competition for Xifaxan, causing Baltimore and other third-party payors to pay artificially inflated prices.

The case seeks to recover alleged overcharges and other relief for Baltimore and similarly situated payors.
