When the defense asks for mediation, my immediate answer is "𝗡𝗢"—unless 𝟰 𝗸𝗲𝘆 𝗰𝗼𝗻𝗱𝗶𝘁𝗶𝗼𝗻𝘀 𝗮𝗿𝗲 𝗺𝗲𝘁 𝗳𝗶𝗿𝘀𝘁. 🙅♂️⚖️

To protect my clients and avoid wasting time, the insurance company has to agree to these four terms before we even sit down:

🔹 𝗚𝗼𝗼𝗱 𝗙𝗮𝗶𝘁𝗵 𝗢𝗳𝗳𝗲𝗿: Their initial offer must start in a reasonable range.
🔹 𝗧𝗵𝗲𝘆 𝗣𝗮𝘆: The defense must cover the cost of the mediation.
🔹 𝗥𝗶𝗴𝗵𝘁 𝗠𝗲𝗱𝗶𝗮𝘁𝗼𝗿: We must agree on a mediator who fairly evaluates cases for both plaintiffs and defendants.
🔹 𝗗𝗲𝗰𝗶𝘀𝗶𝗼𝗻-𝗠𝗮𝗸𝗲𝗿 𝗣𝗿𝗲𝘀𝗲𝗻𝘁: The person with actual money authority must be present so we don't hear "we'll have to check and call you back".

𝗪𝗶𝗻 𝗼𝗿 𝗟𝗼𝘀𝗲, 𝗜 𝗚𝗶𝘃𝗲 𝗠𝘆𝘀𝗲𝗹𝗳 𝟮𝟰 𝗛𝗼𝘂𝗿𝘀.

Winning and losing are both part of being a trial lawyer.

After every trial, I give myself one day. If we win, the celebration lasts no more than 24 hours. If we lose, I take that same time to process the emotions, examine what went right, understand what went wrong, and determine what needs to be fixed.

Then it is time to move forward.

Every result offers a lesson—but you cannot allow either victory or defeat to distract you from the next case.

2025 took us into courtrooms across the country, from San Jose to Chicago. But one federal case challenged us more than any other.

It required us to learn a new area of law, apply the facts strategically, defend our expert testimony, and respond to motion after motion—all while facing rulings that often seemed to go against us.

We stayed focused, kept fighting, and ultimately, we won.
