Jeffrey Clark, framed for a 1992 murder by the Meade County (KY) Sheriff's Dept. and Coroner's Office, spent 22.5 years in prison before being exonerated in 2018. Yesterday, a jury awarded him $24.35 million in damages.

"I finally feel like I am able to wake up from a 34-year nightmare," he says.

On Tuesday night, Chicago police shot and killed 20-year-old Roberto Calvario, Jr. of Albany Park. Today, the family is calling for a full and fair investigation into the brutal death of their beloved son and brother. Read the full press release below.

“Mayor Johnson campaigned on a promise of police transparency and accountability,” says attorney for the family David B. Owens. “Today, we call on him to live up to that promise and provide this family with the answers they need about this horrific and unnecessary shooting. Conduct a fair and full investigation, respect the equal dignity of all involved, release any bodycam videos or other footage, and explain—if such a thing can possibly be explained—how an investigation into an alleged property crime justified the violent death of this young man.”

Today, plaintiffs in CHC v. Noem, our lawsuit over excessive use of force against press and protesters by federal troops under Operation Midway Blitz, voluntarily dropped the case, as the operation seems to be over and Bovino and Co. have left the region.

“We won our case the day they left town,” said attorney David B. Owens of Loevy + Loevy and the University of Washington School of Law. “The people of Chicago stood up to the Trump administration’s bullying and intimidation, and showed them they were messing with the wrong city.”

Yesterday, Judge Sara Ellis issued her written opinion in CHC v. NOEM, our lawsuit over the excessive uses of force by federal agents deployed to Chicago. A scathing 233-pp document of DHS abuses and lies under "Operation Midway Blitz," it will surely go down as one of the defining documents of the 2nd Trump administration. Today, Judge Sara Ellis issued a preliminary injunction in our case to protect the First Amendment rights of protesters, clergy, observers, and reporters against excessive force from federal troops in Operation Midway Blitz. This injunction will be in place indefinitely, until the lawsuit itself is settled in federal court.

Tonight, we filed a motion to amend Judge Ellis's Temporary Restraining Order (TRO) to PROHIBIT the use of tear gas, at least until the preliminary injunction hearing Nov. 5th.

We happen to believe that enforcing immigration laws should not require the near daily deployment of tear gas in residential neighborhoods.

Meanwhile, Judge Ellis has ordered Greg Bovino to be in her courtroom tomorrow morning. We'll see what Her Honor thinks enforcing immigration laws should require...

On Thursday, Loevy and our co-counsel filed a notice with U.S. District Judge Sara Ellis of violations of her temporary restraining order, based on an incident that day in Little Village where CBP Commander Greg Bovino appeared to personally violate the TRO by hurling tear gas at a peaceful crowd of demonstrators. Today we filed a supplemental notice, with additional evidence and testimony. BREAKING NEWS: Following Judge Ellis's questioning of DHS officials Monday, Loevy and our co-counsel have filed an amended complaint in our lawsuit, saying DHS forces “have escalated and expanded their suppression of speech and journalism" in the Chicago area We're seeking a preliminary injunction, with the hearing set for Nov. 5.

We also filed for class certification, asking to make this a class-action suit in which our plaintiffs—demonstrators, observers, religious leaders, and reporters—stand for all such people whose 1st Amendment rights have been—or are likely to be—violated by DHS forces in the Chicago area.

“This is what it looks like when people across Chicago come together to protect democracy,” says our co-counsel, attorney Craig Futterman of the Mandel Legal Aid Clinic at the U. of C. Law School.

“Based on the pretext of protecting federal employees and property, the Trump Administration has deployed militarized federal officers to wreak havoc on our neighborhoods, businesses, and homes,” says attorney Steve Art. “Our clients will not tolerate being terrorized by their own government. We will use every legal means available to restore peace and order in our communities.”
