A denial letter from the VA can feel final, but legally it isn't.

Since the VA overhauled its appeals system in 2019 under the Appeals Modernization Act, a veteran who disagrees with a decision generally has 3 routes available:

▪️Supplemental claims let you submit new and relevant evidence that wasn't in the original file
▪️Higher-level reviews ask a senior reviewer at the regional office to reexamine the same record for errors
▪️Board of Appeals review sends the case to a veterans law judge, with the option of a hearing

Which route makes sense usually depends on why the claim was denied. Outcomes vary case by case, and no attorney can promise a result, but a denial doesn't close your file permanently.

We'd be happy to walk you through your options. Find details at comerfordllc.com/veterans-benefits/va-disability-appeals, and reach out at your convenience.

One of the most common questions I hear is whether help from a spouse or an adult child counts toward VA benefits, or whether it has to come from a professional aide.

For purposes of aid and attendance, the VA generally looks at what assistance a veteran regularly needs rather than who provides it. Help from a family member with bathing, dressing, eating, or managing medication can be relevant to a claim. A higher level of benefit may apply when a licensed healthcare professional is required, but family-provided support isn't disqualifying.

What matters most is documentation. This includes a physician's assessment of what a veteran can and can't do alone, treatment records, and statements from the people providing that help.

If someone in your household has taken on that role, it's a detail Comerford Law Office would want to know about. Call 888-950-0110 to talk it through.

Special Monthly Compensation is one of the least understood parts of VA disability law, and one I'm asked about often at Comerford Law Office. SMC is additional compensation the VA can pay on top of a standard disability rating, in cases where a service-connected condition creates needs the rating schedule doesn't fully capture.

The qualifying criteria are narrow. They generally involve severe impairment, including the loss or loss of use of a limb or organ, blindness, being substantially confined to the home, or requiring regular help from another person with daily activities such as bathing, dressing, and eating.

I want to be clear about the limits. A 100% rating by itself doesn't qualify anyone, and most veterans receiving disability compensation won't meet that standard.

If the description above sounds like your situation, my office can review your file before you draw a conclusion. Learn more about VA disability benefits at comerfordllc.com/veterans-benefits, and feel free to reach out anytime.

Helping veterans pursue the benefits they have earned is about supporting people through some of the most challenging moments of their lives. We are honored when clients take the time to share their experiences.

One veteran recently wrote:
"Mr. Comerford is not only a great lawyer, but he is a great human being. He was with me step by step with my disability case and went above and beyond lawyer duties. He cared for my well-being, and that meant a lot to me, and I'll never forget."

We are grateful for the trust our clients place in us and proud to stand alongside veterans as they pursue the benefits they have earned through their service.

Not every service-connected disability is visible. Many veterans live with conditions that cannot be seen but still affect their daily lives, relationships, careers, and overall well-being.

These conditions may include:
🔹Traumatic brain injuries (TBI)
🔹Chronic headaches and migraines
🔹Tinnitus and hearing loss
🔹PTSD and other mental health conditions
🔹Gulf War-related illnesses and symptoms

Too often, veterans minimize their symptoms or assume they do not qualify for benefits because their injuries are not obvious to others. The reality is that invisible injuries can be just as life-changing as physical ones.

If a service-connected condition is impacting your life, you may be entitled to benefits through the VA. Learn more about veterans' disability claims and appeals: https://www.comerfordllc.com

On Agent Orange Awareness Day, we recognize those who have suffered serious health conditions linked to exposure and the challenges many still face when pursuing VA disability benefits.

While the VA recognizes numerous presumptive conditions associated with Agent Orange exposure, veterans may still encounter obstacles involving:
🔹Qualifying service requirements
🔹Medical documentation
🔹Disability ratings
🔹Claims involving conditions not automatically presumed by the VA

Conditions linked to Agent Orange exposure may include prostate cancer, Parkinson's disease, ischemic heart disease, respiratory cancers, and other serious illnesses.

If you or a loved one has questions about an Agent Orange-related disability claim, understanding your rights is an important first step. Learn more here: https://www.comerfordllc.com/

On Purple Heart Day, we pause to honor the brave service members who were wounded or made the ultimate sacrifice while serving our country. The Purple Heart is a symbol of courage, resilience, and sacrifice.

For many recipients, the effects of their service continue long after their military careers have ended. Physical injuries, traumatic brain injuries, PTSD, chronic pain, and other service-connected conditions can have a lasting impact on daily life and employment.

Today, we remember their sacrifices, honor their service, and express our gratitude to all Purple Heart recipients. Thank you for your service.
