$1.625 Million Settlement for the Death of a 68-year-old Female

A 68-year-old mother died after a local area laboratory failed to properly follow a stat order from a home health care provider. In October of 2022, the decedent was being cared for by a home health provider who ordered blood work on a stat basis. Stat means without delay or right now. Those labs were not processed for over six days, and the decedent passed away in the interim. Plaintiff claimed that the decedent died as a result of dehydration, which would have been clearly evident on the labs had they been ordered and processed on a timely basis. The settlement was made on behalf of a Chicago area laboratory. Brad Schulman represented the Plaintiff.

$1.425 Million Settlement for an Elderly Victim of Medical Negligence

The patient presented with a skin lesion on his cheek and underwent a biopsy that was initially misdiagnosed as a rare fungal infection even though the differential diagnosis included potential cancer. The term “differential diagnosis” means a list of all possible conditions that could be causing symptoms. Based on that incorrect interpretation, the treating physician pursued antifungal therapy. No repeat biopsy or timely referral was made, and treatment for the wrong condition continued for months while the lesion progressed. A later biopsy ultimately confirmed the presence of squamous cell carcinoma, with no fungal involvement. The delayed diagnosis and continued inappropriate treatment allowed the malignancy to advance, necessitating unnecessary facial surgery. Patrick J. Giese represented the plaintiff.

$1.7 Million Settlement for Missed Stroke on Head CT

On November 1, 2020, a 37-year-old woman presented to the Emergency Department at a Chicagoland hospital with complaints of increased blood pressure, dizziness, and headache. A CT scan of her head was ordered and interpreted by the defendant radiologist, who read the study as showing no intracranial abnormalities when he compared it to a 2019 head CT.

Eight days later, the plaintiff passed out at work and was brought back to the emergency department where she was diagnosed with a stroke and transferred the next day to a higher level of care.
Plaintiff’s radiology and neurology experts both testified that the November 1, 2020 scan showed abnormalities, specifically when compared to the 2019 scan. Had the abnormalities been recognized, secondary stroke prevention treatment would have been instituted on November 1, 2020, and the stroke eight days later would not have occurred.

As a result of the stroke, the plaintiff suffered a minor vision loss of her right eye.

The settlement included $200,000 paid by the defendant Chicagoland hospital and $1.5 million paid on behalf of the defendant doctor. Brian Fetzer and Brad Schulman of Napleton & Partners represented the plaintiff.

$216 Million Jury Verdict in Favor of Stabbing Victim

Jack Goldrick, Rory Cannon, and Bob Napleton secured a $216,000,000 jury verdict in the Circuit Court of Cook County. The plaintiff, an off-duty Chicago police officer, was violently stabbed 13 times by defendant Stephanie Campbell-Ward at the corner of Artesian and Fargo, approximately one block away from the Mark II Lounge. The Mark II Lounge was a North Side late-night bar open until 4 a.m. Plaintiff alleged that defendants Stephanie Campbell-Ward, Brandon Westbrook, and Dorothy Howard engaged in willful and wanton misconduct. The incident was captured on video taken by a neighborhood resident. Plaintiff asserted that the three intoxicated defendants acted in concert with one another and defendants Stephanie Campbell-Ward, Brandon Westbrook, and Dorothy Howard facilitated the stabbing of the vulnerable plaintiff, whose blood alcohol level was .242. Mid-trial, the plaintiff settled with the Mark II Lounge for $500,000. Plaintiff claimed the security at the bar was inadequate. The jury awarded $2,145,713 in compensatory damages and $214,517,300 in punitive damages. The punitive damages award is not dischargeable by declaring bankruptcy. Plaintiff’s attorneys intend to vigorously attempt to collect the entire judgment against the defendants.

$1,550,000 Million Settlement

Expectant mother (39 weeks gestation) presented to Cook County Stroger Hospital because her water broke. She was going through a long labor. When she became completely dilated, the fetal monitor tracing was abnormal, and the baby was not delivered in a timely manner. The child was born neurologically depressed but has met all developmental milestones since birth. Bradley Z. Schulman of Napleton & Partners represented the family.

$1 Million for Wrongful Death of Grundy County Woman

The adult children of a 60-year-old Grundy County woman have settled their lawsuit against a Chicagoland Hospital and Doctor regarding medical negligence that resulted in the tragic death of their mother. On August 22, 2020, the patient presented to the Hospital for complaints of abdominal pain. A CT scan of the abdomen showed free intraperitoneal air and fluid, compatible with bowel perforation. On August 24, 2020, at 8:45 p.m., a nurse called the Defendant Doctor due to the patient’s condition deteriorating. The Doctor did not come into the Hospital to address the patients’ worsening condition, and at 11:36 p.m., she coded. On August 25, 2020, she expired. An autopsy determined that the cause of death was septic and hypovolemic shock due to acute peritonitis from a perforated gastric ulcer. $750,000.00 was paid by the Doctor’s insurance company, and $250,000.00 was paid by the Hospital. $8 Million Settlement for Obstetrical Negligence

On March 30, 2024, mom presented to a local area hospital at 24 weeks gestation with potential signs of pre-term labor. She was sent home without a cervical exam or a proper workup for pre-term labor. The next day, mom presented to the local area hospital in active labor. The baby was delivered 2 hours later. The baby spent seven (7) months in the NICU but is now neurologically normal and is hitting developmental milestones. The settlement was paid by a local area hospital. Brad Schulman and Robert J. Napleton represented the minor and parents.

$1.5 Million Settlement for Failure to Diagnose a Benign Hip Tumor

Plaintiff was a 30-year-old Caucasian male who presented to a local area orthopedic surgeon for complaints of hip pain. An MRI was performed after a workup, which showed a cyst in the left hip. That MRI could not determine whether the lesion was cystic in nature or whether it was a tumor. No biopsy or testing was performed to confirm the nature of the cyst. Surgery was performed, however, the cyst was not biopsied. Plaintiff went on to develop a giant cell type of tumor and needed a total hip replacement.
