Every week I receive at least one, and sometimes several, notices to withdraw as counsel from Assistant United States Attorneys from the Northern District of Illinois who are leaving that office. Time will tell if replacements can be brought in fast enough to fill the void.

Recently, I won a federal jury trial for a gun offense for a client in the Northern District of Illinois. The conviction rate in federal court is usually in the high 90% + range. I am extremely proud of this one.

I am frequently seeing body worn camera video of citizens who are stopped for traffic violations and are ordered out of the car by the police. Many assert that they know their rights and do not have to get out of the car. Sadly, that is not true. In Pennsylvania v. Mimms the United States Supreme Court held that an officer may order a driver of car stopped for a traffic violation to exit the vehicle. Worse, the Supreme Court held in Maryland v. Wilson that the police may also order passengers out of a car stopped for a traffic violation. If the police order you to get out of a car, do it. But say you do not consent to any searches. That way if they search you or your car you have a stronger motion to suppress the evidence.

Starting January 1, 2023 bond reform goes into effect. Some defendants held in the jail may be released, but others who are on bond can potentially have that bond revoked. The new law is complex and having an experienced lawyer to fight any attempts by the prosecution to convert a bond to no bond is essential.

If someone in your life has just been arrested, they will be brought to a police station. The police will either charge them or let them go, but they may interrogate them first. People often try to talk themselves out of trouble but instead make things worse and eliminate defenses. For example, the police may pick up a suspect based on a rumor that he was in a fight with another person and that person was hurt. If the person says it was self-defense, he has cost himself the mistaken identification defense and saved the prosecution the trouble of proving he was the person in the fight.
