Illinois law no longer uses the term “custody.” Instead, the legal concept is known as the allocation of parental responsibilities. This includes issues related to decision-making and parenting time.

Some of the hardest assets to divide are pensions, retirement plans, insurance policies, and stock options. These may not only have property interests, but may also be treated as income, either of which may trigger tax and other federal obligations. In Illinois, state law calls for the equitable division of property, but other jurisdictions may require consideration.

Equitable, in Illinois law, does not mean an equal division of property, but looks at property-based factors such as marital or individual property, the abilities of each spouse to earn a living after divorce, and health.

While some couples may be able to agree how to divide their property without a trial, some couples can’t agree or the properties are too complex for simple division. In these cases, a judge in the Illinois Circuit Court will divide the marital estate following a trial prior to granting a Judgment of Divorce.

It is wise for each spouse to hire an attorney who provides forensic accounting. An attorney who provides forensic accounting will track down, catalog, and value the joint property to present as evidence to a judge. This is especially important for finding hidden assets, or dealing with complex issues of retirement benefits, pensions, stocks, or bonds.

Dissolution of marriage is Illinois’ legal term for what is commonly known as divorce. It is the formal process of ending a marriage through the court system and involves resolving several key issues:

🟠 Division of marital property and debts
🟠 Determining maintenance (formerly known as alimony)
🟠 Allocation of parental responsibilities and parenting time
🟠 Establishment of child support

Unlike annulments, which void a marriage as if it never existed, or legal separations, which allow spouses to live apart without ending the marriage, dissolution terminates the legal relationship entirely. After a dissolution, both parties are free to remarry, and marital obligations are finalized according to the court’s order or a marital settlement agreement.

Many divorcing parents are concerned about how their child’s college education will be paid for, and rightly so. College costs in the U.S. are steadily climbing, and planning ahead can be challenging when you’re also managing property division, spousal maintenance, and parenting time arrangements.

Illinois law provides specific guidance on this issue under Section 513 of the Illinois Marriage and Dissolution of Marriage Act. This provision allows courts to allocate college-related costs between divorced parents, even after the child turns 18 and custody orders technically end.
