Unlike traditional litigation, divorce mediation offers the opportunity for creativity, where you and your spouse can explore different options to resolve a particular issue. Mediation is about what will work best for your future, and I believe that you deserve to control that outcome on your own terms. As you approach difficult decisions, I encourage you both to brainstorm any and all possibilities. Then we can evaluate objectively the advantages and disadvantages to fully understand what each possibility would entail.

The atmosphere of mediation matters.

The atmosphere created in mediation is a significant part of the process. Instead of the hostility and antagonism common to traditional divorce proceedings, mediation offers civil conversation, cooperation, respectful listening, and a focus on making agreements that will serve you to move ahead without rancor and without reliving the past.

Read David's latest blog post: “The Choice to Be a Mediator”––the first in a series of blogs about David Louis, Chicago divorce mediator. Find out why David’s clients consistently praise his expertise, trustworthiness, compassion, organizational skills, and professionalism.

In this first entry David describes the decision to adopt mediation as a second career. Mediation is a future-focused process, where clients are the decision makers rather than the mediator. David moves clients through civil, productive conversations to agreement on all the financial and practical issues involved in ending a marriage.

My goal is to help clients be at their best when they start working together in the mediation process. I employ an insight process to prepare clients individually, using workbooks to give each person space to think and speak on their own, without fear of judgment. The insight process helps clients consider values, why they are doing mediation, how they make decisions, their attitudes toward money, and how to approach conflict. Workbooks use pertinent questions to help individuals become self-prepared and also understand where the other person is coming from.

Litigation versus mediation––Controlling your future
Mediation puts you in charge. You control costs by choosing one mediation professional instead of two lawyers. You control pace, scheduling sessions on your timeline, not the court’s or lawyers’. Because mediation offers a calm, respectful space to discuss difficult issues, you control not just outcomes but the process itself, with good communication that avoids the tension common in litigated divorces.

In mediation, couples need to be ready for hard conversations—going beyond mistrust and improving communication. I meet individually with clients to help each be more prepared to speak in joint sessions. I might say to an individual, “I want you to feel you have freedom to speak without any concern about how what you say is received. What is it that you want to say that you feel may not be understood?” Self-preparation is useful for mediation sessions—hearing yourself speak to see if it feels genuine and getting beyond the fear of saying it.

Mediation is a non-adversarial process for resolving disputes effectively. At the beginning of mediation, I often find that clients do not communicate well. So I promote mutually acceptable decisions by addressing difficult dynamics. Mediation emphasizes negotiation and two-way conversation. This promotes understanding and mutual learning. If you understand each other, it shows that you are listening. Then a foundation exists to explore what matters to each of you.
