📂 If you haven’t formed a business entity yet, you are operating as a sole proprietor.

📕 With a sole proprietorship, there's no legal separation between the business and the owner. This means that the owner would be personally responsible for the business's liabilities (ie: an unsatisfied client/customer could go after your personal assets).

📗 However, with a limited liability company, the business is a legally separate entity from the owner. The owner isn't personally liable for the business's liabilities.

You want to be proactive, not reactive, when it comes to your legal needs.

Proactive: (1) Being the first to file your trademark; (2) Including provisions in your contracts that protect you in the event of a dispute; and (3) Having a properly formed business entity to limit your personal liability.
Reactive: (1) Rebranding because you got a Cease & Desist letter; (2) Filing an opposition to a trademark; and
(3) Starting trademark cancellation proceedings.

You save money when you are proactive. When you are reactive, there is no limit to the amount you will spend.

The same way you budget for marketing, branding, inventory, packaging, systems, and subscriptions — don’t forget to include legal expenses in your company’s budget.

Your brand is way too 𝗩𝗔𝗟𝗨𝗔𝗕𝗟𝗘 to go unprotected.

If you’re serious about your brand, then a trademark is non-negotiable.

Trademark = Brand protection

🗣Your brand is not officially yours without a federal trademark.

🗣 Someone else can beat you to the trademark office and file an application for your brand name/logo/slogan before you do. Don’t let this happen to you.
