Creating an estate plan is an important step—but life doesn’t stand still after the documents are signed.

And choosing them can be just as important as creating the documents themselves.

Who do you trust to administer your estate?

Who could responsibly handle financial matters for you?

Who would you want making healthcare decisions if you couldn’t make them yourself?

If you have minor children, who would you nominate to care for them?

Caring for someone you love through a terminal illness can consume nearly every bit of your attention. ❤️

And understandably, what happens afterward may be the last thing you want to think about.

But there can be value in having that conversation before you’re grieving.

Speaking with an attorney ahead of time doesn’t mean rushing the process or giving up hope. Every family and every estate is different.

It can simply give you an opportunity to understand what may happen when the time comes—who will be responsible for what, what documents and information may be needed, whether probate or estate administration may be involved, and which steps will need attention first.

Then, when your family does experience the loss, you’re not starting from zero while trying to grieve at the same time.

Funny how an upcoming trip can suddenly move estate planning to the top of the to-do list. ✈️🌎

We often hear from people who have been meaning to get their estate plan in place, and then a vacation or international trip gives them the push to finally take care of it.

It makes sense.

Before you leave, you may want the peace of mind that comes from knowing:

✓ The people you trust have the appropriate authority to act if necessary.
✓ Your medical wishes are documented.
✓ You’ve considered who would care for your minor children.
✓ Your important documents are in place and accessible to the right people.
✓ Your family knows there’s a plan.

And remember—estate planning isn’t necessarily just about having a will.

Depending on your individual circumstances, your plan may also include powers of attorney, an advance medical directive, a trust, or other planning.

The goal isn’t to spend your vacation worrying about what could happen.

Quite the opposite.

Who is a good candidate for estate planning?

You might be surprised by the answer.

You don’t need to be wealthy.

You don’t need to be retired.

And you certainly don’t need to have some enormous estate.

If you own a home, have children, share your life with someone, own a business, have financial accounts, care about who would make decisions for you—or simply want a say in what happens if you’re no longer able to speak for yourself—it’s worth having the conversation.

Because estate planning isn’t only about what happens to your things when you die.

It’s also about what happens to you while you’re living.

Who could handle your financial affairs if you couldn’t?

Who could make medical decisions for you?

Who would care for your children?

And eventually, who receives what you’ve worked for?

The important part is that everyone’s answer is different.

“I just need a will.”

And sometimes, that may be exactly where the conversation leads.

But estate planning isn’t about checking a box or giving every client the same stack of documents.

A will addresses what happens after you pass away. But what happens if you’re still here and, because of an illness, accident, or other circumstance, you’re unable to handle your own affairs?

Who can manage financial matters for you?

Who can make medical decisions if you can’t?

Are the people you’ve chosen actually given the legal authority they’ll need?

Those are some of the questions Lisa considers when she sits down with a client.

Sometimes that means recommending a power of attorney or an advance medical directive in addition to a will. Other situations may call for different planning altogether.

Someone passes away and leaves assets in a trust.

There’s money in the account. There are beneficiaries waiting. So the trustee just divides everything up and writes the checks…right?

Not necessarily.

Trust administration can involve much more than distributing money.

The trustee generally has responsibilities that can include understanding the terms of the trust, identifying and managing trust assets, addressing expenses and tax matters, maintaining records, communicating with beneficiaries, and ultimately making distributions according to the trust’s instructions.

And those instructions matter.

One beneficiary might receive assets outright. Another might receive them over time. A trust might contain conditions or give the trustee certain discretion.

That’s why “What seems fair?” isn’t necessarily the right question.

The better question is:

“What does the trust require?”

If you’ve been named trustee and aren’t sure what happens next, getting guidance before distributing assets can help avoid mistakes that may be difficult to undo.

But when there’s no plan, questions quickly become confusion.

“Where’s the will?”
