Who is a good candidate for estate planning?

You might be surprised by the answer.

You don’t need to be wealthy.

You don’t need to be retired.

And you certainly don’t need to have some enormous estate.

If you own a home, have children, share your life with someone, own a business, have financial accounts, care about who would make decisions for you—or simply want a say in what happens if you’re no longer able to speak for yourself—it’s worth having the conversation.

Because estate planning isn’t only about what happens to your things when you die.

It’s also about what happens to you while you’re living.

Who could handle your financial affairs if you couldn’t?

Who could make medical decisions for you?

Who would care for your children?

And eventually, who receives what you’ve worked for?

The important part is that everyone’s answer is different.

You may need a will. You may need powers of attorney or an advance medical directive. Your circumstances may call for additional planning.

“I just need a will.”

And sometimes, that may be exactly where the conversation leads.

But estate planning isn’t about checking a box or giving every client the same stack of documents.

A will addresses what happens after you pass away. But what happens if you’re still here and, because of an illness, accident, or other circumstance, you’re unable to handle your own affairs?

Who can manage financial matters for you?

Who can make medical decisions if you can’t?

Are the people you’ve chosen actually given the legal authority they’ll need?

Those are some of the questions Lisa considers when she sits down with a client.

Sometimes that means recommending a power of attorney or an advance medical directive in addition to a will. Other situations may call for different planning altogether.

Everyone’s circumstances are different.

Someone passes away and leaves assets in a trust.

There’s money in the account. There are beneficiaries waiting. So the trustee just divides everything up and writes the checks…right?

Not necessarily.

Trust administration can involve much more than distributing money.

The trustee generally has responsibilities that can include understanding the terms of the trust, identifying and managing trust assets, addressing expenses and tax matters, maintaining records, communicating with beneficiaries, and ultimately making distributions according to the trust’s instructions.

And those instructions matter.

One beneficiary might receive assets outright. Another might receive them over time. A trust might contain conditions or give the trustee certain discretion.

That’s why “What seems fair?” isn’t necessarily the right question.

The better question is:

“What does the trust require?”

If you’ve been named trustee and aren’t sure what happens next, getting guidance before distributing assets can help avoid mistakes that may be difficult to undo.
