If you have a power of attorney in place, or you are thinking about setting one up, there is a new safeguard in Virginia law worth knowing about. As of July 1, 2026, an agent can only be relieved of their duty to disclose their actions if the person granting the power of attorney signs a clear, separate statement acknowledging that choice.

This matters because power of attorney abuse is one of the more common forms of elder financial exploitation, and it can happen quietly, without the family ever knowing until it is too late.

✔️ Applies to powers of attorney created on or after July 1, 2026
✔️ Adds a real safeguard against elder financial exploitation
✔️ A good reason to review any older POA documents you already have
