Can someone take back a guilty plea after they've already been convicted?

It's possible, but it's extremely rare.

Our latest blog examines Bryan Kohberger's request for post-conviction relief and explains why these petitions face such a high legal standard.

Here's what we cover:

➡️ What post-conviction relief is and when it may apply
➡️ Why withdrawing a guilty plea after sentencing is so difficult
➡️ How claims of ineffective assistance of counsel are evaluated
➡️ Why courts require strong legal evidence before reopening a case
➡️ David Gelman's perspective as a former prosecutor on why these motions almost never succeed

Gun laws vary from state to state, and crossing into New Jersey with a legally owned firearm from another state can have serious consequences.

Many people are surprised to learn that a firearm legally purchased and possessed elsewhere may still lead to criminal charges in New Jersey if it doesn't comply with the state's strict gun laws. Understanding New Jersey firearm laws before you travel is essential.

If you've been charged with a gun offense, speak with an experienced New Jersey criminal defense attorney as soon as possible.

When does a mental illness mean someone is not criminally responsible for a crime?

The Lindsay Clancy trial is bringing that question into the national spotlight. In our latest blog, we break down David Gelman's legal analysis and explain how mental illness defenses work in criminal cases.

Here's what we cover:

➡️ The legal standard for proving a defendant is not criminally responsible due to mental illness
➡️ Why having a mental illness alone is not enough to avoid criminal liability
➡️ How psychiatric experts and medical evidence can influence a jury's decision
➡️ The difference between a mental health diagnosis and a successful legal defense
➡️ Why the Lindsay Clancy case could shape public understanding of these complex legal issues

TV makes criminal cases look like they're over in an hour. Real life doesn't work that way.

A criminal case can take months or even longer to resolve. Court schedules, evidence review, negotiations, and legal motions all take time. While the process can be frustrating, patience and the right legal strategy are key.

If you're facing criminal charges, don't judge your case by what you see on television. Every case follows its own timeline.

Missing your court date is one of the worst mistakes you can make in a criminal case.

Depending on the circumstances, failing to appear in court could result in a bench warrant for your arrest or additional penalties that make your case even more complicated. If you have a scheduled court appearance, show up or contact your attorney immediately if there's an emergency.

A missed court date won't make your case go away. It can make it much harder to resolve.

Why do prosecutors sometimes file so many charges?

It's often a strategic decision. Prosecutors may bring every charge they believe the evidence supports to increase leverage during plea negotiations. That doesn't mean every charge will ultimately hold up in court.

If you're facing multiple criminal charges, don't assume the case is already decided. An experienced criminal defense attorney can challenge the evidence, negotiate on your behalf, and build the strongest possible defense.
