Five conversations you should be having with your parents or seniors in your life:

1. Do you have an updated Will and/or Living Trust? A Will or Trust prepared 20-25 years ago when responsibilities were very different may not be as effective today.

2. Who will make medical decisions for you if you’re unable to? Without a medical/healthcare directive in place, families may end up in court to obtain authority to act on your behalf.

3. Who will manage your business and/or finance affairs on your behalf if it becomes necessary? A durable POA is one of the most important documents that can protect your interests later in life (or sometimes sooner than you think).

4. Have you thought about long-term care? Assisted living and nursing home costs are rising rapidly. Medicare won’t cover all these potential costs.

5. Most important- Where are the important documents? The best plan is useless if your trusted loved ones have no idea where to locate these documents.

Remember- the conversations can happen over a period of time, but have the conversations soon.

➡ Important Reminders When Estate Planning For Blended Families:

1️⃣ Update Beneficiaries Immediately-Beneficiary forms on life insurance and retirement accounts supersede your will or trust. Ensure they reflect your current, not former, spouse and/or your designated desires regarding your children.

2️⃣ Tennessee Intestacy Laws- Without a will (or trust) Tennessee law does not automatically protect stepchildren, and a new spouse may inherit the majority of assets, potentially disinheriting children from previous relationships.

3️⃣ Review Property Titles- Determine if property is held as "Tenants by the Entirety" (automatic transfer to spouse) or "Tenants in Common" (passes to your heirs) to ensure it aligns with your goals.

4️⃣ Update Powers of Attorney: Ensure your current spouse or a trusted person is named to make financial and medical decisions, rather than a former spouse.

5️⃣ Plan for Remarriage Risks: Structure trusts to protect your children’s inheritance if your surviving spouse remarries later.

➡ Key Life Phases and Estate Planning Focus:

☑ Young Adulthood (Single/Newly Married): Focus on incapacity planning. Establish a durable power of attorney for finances, a healthcare proxy, and a simple will to direct assets.

☑ Growing Family (Children): Crucial stage to update documents. Name guardians for minor children, consider life insurance, and set up trusts to manage inheritances for minors.

☑ Mid-Life/Career Peak: Focus on wealth accumulation and asset protection. Revise estate plans to account for increased assets, review beneficiary designations.

☑ Empty Nesters/Pre-Retirement: Review guardianship (likely no longer needed) and focus on retirement asset protection. Update health care proxies to reflect current relationships.

What Happens If You Die Without A Will (or Trust)?

➡ In the State of Tennessee, if you pass away intestate (without a will), your probate assets are distributed to heirs-at-law based on state law, not according to your desires or wishes.

1️⃣ A surviving spouse generally inherits everything if there are no children.

2️⃣ If there are children, the surviving spouse gets the greater of one-third or a child’s share if children exist. A child’s share depends on how many children there are.

3️⃣ If you don’t have a spouse or a line of children (children, grandchildren, great-grandchildren), then the property goes to your parents.

4️⃣ If your parents predeceased you, then the property goes to brothers and sisters.

5️⃣ Next in line are grandparents and other relatives.

6️⃣ If there are no living relatives, then Tennessee gets the Estate property

Note: Parents who owe child support cannot inherit until all support arrearages have been paid.

For these and other reasons, it’s important to have an Estate Plan as well as non-probate assets (i.e. beneficiary designations), in place so that you can control how your assets are distributed after you pass away.

This highlights a real gap between best intentions and action. Common reasons for inaction: Procrastination, perceived high cost, and the belief that estate planning is only for the wealthy or elderly….

3. Based on 2025 data, it’s estimated that 55% of Americans will be unprepared (as they lack a will or other essential document) if a sudden life event occurs.
