When should an IBS diagnosis lead to more testing?

IBS can cause significant digestive symptoms, but persistent or worsening problems may be a reason for doctors to investigate further. Ongoing nausea and vomiting, unexplained weight loss, feeling full after eating very little, dehydration, repeated ER visits, or abnormal lab results can all be important pieces of a patient's medical history.

In some cases, symptoms initially attributed to IBS may ultimately be connected to another condition, such as gastroparesis. The question in a potential New Jersey medical malpractice case is not simply whether the original diagnosis was wrong. It is whether the healthcare provider appropriately responded to the patient's symptoms, test results, medical history, and other warning signs.

If serious gastrointestinal symptoms were repeatedly dismissed or a diagnosis was delayed, a review of the medical records can help determine whether appropriate testing and follow-up should have occurred.

Was the other driver on their phone before your crash? The police report may not tell the full story.

A new study found that cellphone use before crashes may be significantly underreported. Researchers detected phone use in the 30 seconds before impact in about 7% of single-vehicle crashes and 8% of two-vehicle crashes studied, while police reports documented phone use less than 1% of the time.

For drivers injured in a New Jersey distracted driving accident, that gap matters. Even when a police report doesn't mention a cellphone, evidence such as phone records, vehicle data, traffic or surveillance footage, witness statements, and driver statements may help establish distraction and fault.

If I recover compensation in a third-party workplace injury lawsuit, do I lose my workers’ compensation benefits?

No. In most cases, you can still receive workers’ compensation benefits while pursuing a third-party claim against someone other than your employer.

However, if you recover compensation in a third-party lawsuit, you may be required to reimburse a portion of certain workers’ compensation benefits you already received. New Jersey law generally does not allow injured workers to be paid twice for the same losses.
