Matter of Delcarmen-Lara, 29 I&N Dec. 830 (BIA 2026)
Matter of Arrabally and Yerrabelly, 25 I&N Dec. 771 (BIA 2012) ሽሮታል።
INA § 212(a)(9)(B)(i)(II)

BIG USCIS UPDATE FOR IMMIGRATION LAWYERS & APPLICANTS

USCIS announced a major change on August 5, 2026 concerning Requests for Evidence (RFEs) and Notices of Intent to Deny (NOIDs).

Under the updated guidance, USCIS may deny certain immigration benefit requests without first issuing an RFE or NOID when the applicant has not established eligibility and the evidence submitted is insufficient.

⚠️ This means applicants should not assume USCIS will give them another opportunity to submit evidence before issuing a denial.

📌 The best practice is to make sure the initial filing contains all required evidence and a strong legal and factual record from the beginning.

IFR: Affirmative Asylum Referrals Without an Interview
On July 28, 2026, the Department of Homeland Security (DHS) issued an interim final rule (IFR) to allow asylum officers (AOs) to refer certain affirmative asylum cases to an immigration judge (IJ) without first conducting an interview. The IFR is effective immediately and applies to pending applications.
For applicants without ongoing legal status, the rule allows AOs to refer without interview "in various situations, including but not limited to, when the [applicant] is barred from applying for asylum due to the one-year filing deadline, is barred from a grant of asylum, does not merit a grant as a matter of discretion, or is not eligible on the merits of the claim." AOs may now make discretion determinations prior to determining eligibility and need not include credibility determinations in referrals. DHS asserts that interviews will still be conducted as required by other legislation or settlement agreements.
