On June 30, 2026, the United States Supreme Court issued a landmark decision in West Virginia v. B.P.J. and upheld the constitutionality of the West Virginia’s Save Women’s Sports Act which prohibits biological male student athletes from competing on female school sports team. This decision is a major victory for fairness and safety in women’s athletics and sets a national precedent which directly impacts the majority of the states that have enacted similar laws.

Kelly C. Morgan and Kristen V. Hammond of Bailey & Wyant, PLLC, represent the West Virginia State Board of Education and W. Clayton Burch, in his official capacity as State Superintendent of Schools, in this groundbreaking case.

Bailey & Wyant, PLLC is pleased to introduce our 2026 Summer Interns.

Chase Robinson is spending his summer in the Charleston office. Chase is a local Charlestonian, born in Charleston, and graduated from WVU with a Bachelor of Science in Journalism, and Public Relations with a double minor in Communications and Political Science. He is a rising 3L at WVU College of Law.

When asked why he chose Law for a profession, Chase answered, “I honestly think I went to law school because I knew it could open doors for me that I wouldn’t have without it and I really wanted to continue going to school. I want to get into government in some capacity, whether that being in government relations, litigation, policy work, or something similar.” During his down time Chase enjoys kayaking, reading, taking an occasional run, and has been known to often binge watch series.

Emily Lewis is our Martinsburg intern. Emily grew up in Charles Town, West Virginia, and attended Virginia Wesleyan University and received a bachelor’s degree in criminal justice. She is currently a rising 3L at the West Virginia University College of Law. When asked why the practice of law, Emily responded, “I’ve known I wanted to go to law school since I was a kid because I love reading, writing, and helping others. I want to be a litigator – I love being in court.” Outside of law school, Emily loves animals (especially her cats), swimming, baking, and spending time with her fiancée.

His peers have consistently recognized his excellence; he was named Lawyer of the Year by the Defense Trial Counsel of West Virginia and holds the AV® Preeminent™ Peer Review Rating from Martindale-Hubbell®, signifying the highest level of professional achievement and ethical standards. Over the years, his accomplishments have also earned him additional distinctions, including recognition as a Governor’s “Go-To” Attorney by the National Law Journal, Defense Attorney of the Year (2017) by the Defense Trial Counsel of West Virginia, inclusion in Super Lawyers® and Best Lawyers in America® since 2018, and the 2025 WV Executive Lawyers & Leaders Award.
