It is with a somber but grateful heart that we announce the dissolution of Freeman & Chiartas effective January 31, 2023. As always our intentions are to make make our transition seamless for our current clients. This was not an easy decision but it is never easy to make life changes. We are entered a new season in our lives. Previous client files will be stored for a period of 5 years from the conclusion of representation. For those of you we have reprepresented over the last 32 years, it has been an honor. Thank you for the confidence you have shown in our firm. Without you our lives would not have been the same. SAFETY TIPS FOR WINTER DRIVING:

Severe weather can be both frightening and dangerous for travelers. Winter storms, bad weather and sloppy road conditions are a factor in nearly half a million crashes and more than 2,000 road deaths every winter. Drivers should know the safety rules for dealing with winter road emergencies. Freeman & Chiartas urges drivers to be cautious while driving in adverse weather.
Here are some of the “Top Tips” for driving in snowy, icy and frigid conditions:

BEFORE YOU GO:
1) Keep a bundle of cold-weather gear in your car, such as extra food and water, warm clothing, a flashlight, a glass scraper, blankets, medications, and more.
2) Make certain your tires are properly inflated and have plenty of tread.
3) Keep at least half a tank of fuel in your vehicle at all times.
4) Never warm up a vehicle in an enclosed area, such as a garage.
5) Do not use cruise control when driving on any slippery surface, such as on ice and snow.

TIPS FOR DRIVING IN SNOW:
1) Stay home. Only go out if necessary. Even if you can drive well in bad weather, it’s better to avoid taking unnecessary risks by venturing out.
2) Drive slowly. Always adjust your speed down to account for lower traction when driving on snow or ice.
3) Accelerate and decelerate slowly. Apply the gas slowly to regain traction and avoid skids. Don’t try to get moving in a hurry and take time to slow down for a stoplight. Remember: It takes longer to slow down on icy roads.
4) Increase your following distance to five to six seconds. This increased margin of safety will provide the longer distance needed if you have to stop.
5) Know your brakes. Whether you have antilock brakes or not, keep the heel of your foot on the floor and use the ball of your foot to apply firm, steady pressure on the brake pedal.
6) Don’t stop if you can avoid it. There’s a big difference in the amount of inertia it takes to start moving from a full stop versus how much it takes to get moving while still rolling. If you can slow down enough to keep rolling until a traffic light changes, do it.
7) Don’t power up hills. Applying extra gas on snow-covered roads will just make your wheels spin. Try to get a little inertia going before you reach the hill and let that inertia carry you to the top. As you reach the crest of the hill, reduce your speed and proceed downhill slowly.
8) Don’t stop going up a hill. There’s nothing worse than trying to get moving up a hill on an icy road. Get some inertia going on a flat roadway before you take on the hill.

TIPS FOR LONG DISTANT WINTER TRIPS:
1) Be Prepared: Have your vehicle checked by state licensed Auto Repair facility before hitting the road.
2) Check the Weather: Check the weather along your route and when possible, delay your trip if bad weather is expected.
3) Stay Connected: Before hitting the road, notify others and let them know your route, destination and estimated time of arrival.

IF YOU GET STUCK:
1) Stay with your vehicle: Your vehicle provides temporary shelter and makes it easier for rescuers to locate you. Do not try to walk in a severe storm. It is easy to lose sight of your vehicle in blowing snow and become lost.
2) Don’t over exert yourself: When digging out your vehicle, listen to your body and stop if you become tired.
3) Be Visible: Tie a brightly colored cloth to the antenna of your vehicle or place a cloth at the top of a rolled up window to signal distress. At night, keep the dome light on if possible. It only uses a small amount of electricity and will make it easier for rescuers to find you.
4) Clear the Exhaust Pipe: Make sure the exhaust pipe is not clogged with snow, ice or mud. A blocked exhaust pipe can cause deadly carbon monoxide gas to leak into the passenger compartment of the vehicle while the engine is running.
5) Stay Warm: Use whatever is available to insulate your body from the cold. This could include floor mats, newspapers or paper maps. Pre-pack blankets and heavy clothing to use in case of an emergency.
6) Conserve Fuel: If possible, only run the engine and heater long enough to remove the chill. This will help to conserve fuel.

It’s raining here in Charleston West Virginia on the last day of 2020. A miserable day seems like a fitting exit for such a miserable year! You may have heard the phrase “Better to Light a Candle Than to Curse the Darkness”. This quote has beeen attributed to many different people. Regardless of who gets credit for it, I thought of this quote when reflecting on 2020. I won't rehash the many issues that have changed our lives in 2020, as we are each painfully aware of the personal, political, and economic darkness that this year has brought upon us.
I choose to look to 2021 with anticipation of a brighter, healthier, and more prosperous and unified future. To quote Nick Frederickson: “I close my eyes to old ends and open my heart to new beginnings”. It is with great sadness that I learned the news of Kanawha County Circuit Judge, Charlie King's passing. Charlie became a Judge in 1988 when I was practicing for only 5 years. Whenever I entered his court room, I had no doubt my argument would be heard, I would be treated with respect and most importantly my client(s) would receive a fair hearing. It's always nice to receive a little recognition for your hard work. I want my clients to know that when they hire me or my firm they are getting a person with the legal abilities, knowledge, skills and professional ethics to get the job done. Today is National Voter Registration Day. If you haven't registered to vote please take the time to do so as soon as possible. Maybe even today? In my lifetime I am not aware of a more consequential election. With the recent passing of Titan Ruth Bader Ginsburg the balance of SCOTUS is now in play. Trump has already said that unless he wins he is going to contest the election through his corrupt AG Bill Barr. He intends to use the federal courts which have been packed by McConnell during this term with neo-cons judges and then ultimately the SCOTUS. We saw what happened in 2000 when SCOTUS decided the hanging chad issue in Florida. Bush won by 538 votes even though Gore won the popular election by more than 500,000 votes. We are still in Afghanistan and Iraq. This time we are talking about losing control of Democracy itself. All norms have been shattered by this administration. Not only will SCOTUS overturn Roe v. Wade some of the Justices have indicated the may take a look at Brown v. The Board of Education. Do you want a nation divided or united? Do you want to move our judicial system backwards 50 years. Do you want a malignant narcissist who time and time again shows us that the law does not apply to him or his friends? Time to end the Orange Plague, restore our laws, embrace science and be honest and transparent with the American people. Register today and Vote Blue all the way through!!
